Sent SAR plus £10 - 17/11/06. Response today from Rachel Claridge, Assistant Vice President. 2 page diatribe re MBNA’s rights to charge, blah, blah, blah. However, say have not treated request as S.A.R because they provided info ‘free of charge’ & credited £10 to ‘my account’. Card paid off in full in Feb 06 & let sent to close my A/c. How can they credit the £10 to my account, if it doesn’t exist? As a goodwill gesture offered £70 & my £10 = £80 which doesn’t equate to amounts they have taken over the years. Do I respond asking them to provide info as S.A.R and give them 40 days from 17/11? Has ne1 else had this type of response from MBNA? :-o

Yes, just received response. They have sent me 5 statements that I did not expect, and two more (that I expected) are missing. I have sent them a letter for non compliance with SAR and given them 5 working days to send missing statements.

 

Although I received exactly same letter, it says they'll send me a cheque for £90 as full and final settlement. I won't be accepting that. If I were you calculate your charges (as per spreadsheet provided on Library) include commercial interest at 24.9% from day of charges to final date of settlement and send it with your 'preliminary approach for repayment letter' (found in library). Give them 14 days, and then be prepared to hear from them.
