Old A and L Account**won**

I closed my A and L current account four and a half years ago.

 

Am I ok to go for the unfair charges on a closed account, Also is there a limit on how far back I can Claim?

 

Also I have moved mortgages from GMAC 6 months ago can I go for them as well?

it doesn't matter if the account is closed or not. Your arguement remains the same, the charges applied were unfair. Open or closed has no relevence to the claim you make.

 

I believe you can only get info under the DPA for 6 years, so this dictates the timescale somewhat.

Take time to read the forums, people are testing the possibility of going further back, but I think at present it is in early stages.

Inform yourself through the forum & FAQs, then go get em!!

This is incorrect for a couple of reasons, 1st the DPA is about your data and you are entitled to ALL the data an organisation holds on you assuming of course its on a relevant filing system. The banks only use relevant systems as far as i know and despite arguments to the contrary by abbey and Barclaycard the ICO has changed its view and suggests most systems WILL be relevant.

 

2nd, the length of time you can claim back is dependant on the circumstances of the claim (I'm not thinking just of bank charges here) basically Sec 5 of the Limitations act prevents you from claiming back further than 6 years.

 

However, Section 32 gives relief where the claim arises due to fraud, concealment of the breach or the claimant made a mistake in paying something.

 

So ultimately if you want to claim back further than 6 years you have to be able to show the bank either concealed its charges or you made a mistake when you paid the unlawful charges.

Hi I want to get info on how I can get in touch initially with A/L with regard to an old account I had with them over four and a half years ago (I can claim back 6 years right?)

Yes you can claim back 6 years.

 

If your name and address are still the same as when you held the account, send the SAR out of the templates library along with a cheque for £10. If you have moved, you may have to provide proof of your identity.

 

Suggest you would send letter rather than e-mail a) becuse you have to pay £10 and b) because the templates on the forum work - I know - they've just refunded my charges!!!!

Thnx Janquinny for that a minor problem might be that I may not be able to send a cheque as the Woolw acc (Who I am also claiming for ) I have a chequebook with is in limbo with them adding charges to it and me stopping any money going in, and over my OD limit a cheque would bounce (that would be funny)

Yes you can, no point in sending a bouncing cheque!!!

Delboy - will be interested to hear how you get on - I am in the early stages of preparing to claim on an A+L account I closed 2 years ago (because I was sick of all their charges!!) I have seen some posts on here suggesting that if the account was opened prior to 1995 you can claim going back further than 6 years?? Not sure if this is the case or not but plan to look into it!

Hi Del, I sent of my S.A.R Rec Delivery to their Narborough address on the 13/12/06, I also used the Royal Mails Track & Trace service on their website, It states that the letter was delivered on the 16/12/06 but it would appear that it was not signed for!

 

I intend to phone the Royal Mail in the next few days and request a proof of delivery, I think there's a charge for this though?

Now been over 2 weeks and still nothing on the PO website re whereabouts, rang them (what a recorded nightmare !!) I have to wait 15 WORKING days before claiming.

Second SAR sent today with an added sentence :-

 

"Also I require a list of all of the charges made by you to my account THAT HAVE SUBSEQUENTLY BEEN REFUNDED BY YOURSELVES. "
