Hi

i just needed a bit of advice really

 

i was involved in a car accident 2 months ago and had a witness.   

 

last week i received a cheque for the sum agreed at the value of my car from the other drivers insurance company,

i have not been able to leave my house to check it with everything going on.

 

I received a call from a company sorting the claim and who gave me a courtisy car saying his insurance company are now disputing liability from the crash.

I am unable to call my car insurance company till tuesday,

 

should i cash the cheque?

Ive allready lent some money of my mum and put a depost down on a car to pick up when it becomes safer

because i thought i had 2500 pound from the crash,

 

anybody got any idea what to do,

can they give me a cheque then take it back?

 

I thought once they paid me out that is it finished?

I would suspect this is the usual game of the third party saying you could have gotten the hire car cheaper?

we see it all the time here.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Absolutely – the advice is completely correct. You should put the cheque in for payment as quickly as possible – and monitor its progress.

Make sure you keep records of paying in slips et cetera. Take a copy of the cheque before you paid it in.

If they are stupid enough to put a block on it then ask your bank in writing to return the cheque to you (they will have it) and tell us here. We will advise you to sue on the cheque. Bounced checks are an automatic win with very few exceptions.

Agree with the advice already given to cash the cheque, as that is just the third party Insurer paying for your cars write off value.

 

The claims management company acting for you who phoned you are just interested in how they make money from your accident. They arranged a hire car for you and the third party Insurer is refusing to pay the amount being asked for the hire car.  

 

Once you have cashed the cheque and this is shown as being credited to your Bank account, just contact the claims management company to confirm that you have received the write off value for the car from the third party Insurers.

 

Be very careful to check the claims management and hire car document terms you agreed to.  The hire car you agreed to, will not be a courtesy car, but will be a credit hire, meaning that the car was provided to you on the basis that if the third party Insurer refuses to pay some or all of the hire car amount, you will be personally liable for the hire car costs. 

 

How long did you have this hire car ?

 

Did you have access to any other car during this time e.g wife/partners car, other car you own ?

 

Was the hire car similar e.g small 5 door hatchback, to the car you had written off ?

 

On a different matter, have you ever mentioned personal injury would be part of your claim ?

ive been pulling my hair out since they rang friday didnt no where to turn to.

 

going down to the bank 1st thing tuesday and wont speak to any one until its gone through.

sorry dont no how to reply to each message so just going to put it here.

 

Ive had the hire car for 2 months and its a brand new aldi a4 (they gave me a like for like as mine was a bmw 320d).

Had no other car to use and i care for my uncle and have been dropping parcels off to my grandma who cant leave the house so needed transport.  

 

Nothings been said about personal injury

i did go to the doctors to get some strong pain killers as my back was hurting

was a 70 mph crash on the motorway.

 

When the comany who hired the car rang they said the 3rd party have new evidence involving the crash.
