Hi,

 

As I stated in this thread, I was contacted by these people about a debt from years ago from Demon. Well, the first letter I have (that i've found so far) is dated 22/03/06, I thought I'd paid this* but cannot for the life of find any receipt. I've now received another letter on 09/01/08, which I replied with a CCA. I received another letter today (dated 23/01/08) threatening formal recovery procedures.

 

Basically, I just to know if I can find out if I have paid them and why they've taken so long in contacting me again?

* Yes, this was before I found this site and knew my rights regarding CCA's, etc.

The CCA is always the best starting point, but you can follow this up with a SAR's request, to find out what you've paid and any reciepts that have been sent etc

It will need adjusting to fit your particular needs.

 

try it and see what comes back.

 

In the meantime, continue learning/discussing CCA's, the more you learn and research now, the easier things will be for you.

The CCA is always the best starting point,

demon? I assume this is demon internet, in which case it won't be CCA regulated.

 

but you can follow this up with a S.A.R - (Subject Access Request)'s request, to find out what you've paid and any reciepts that have been sent etc

I would do this; you can also look up your bank records.

Unfortunately, it won't show from bank records I don't think. At the time, I had no DD's with demon from my TSB account and so the cash would've been withdrawn and paid to another bank and it wouldn't be the exact amount. So would be hard for me to see.

To Demon I think, as they are the original creditor and will have all records of what you have paid and when.

Also, you could write to 1st Credit explaining the debt is in dispute, asking them to prove you owe the money. I know that there is a letter template on CAG in a thread I started about MH and a phishing letter they sent to me that is excellent.
