Cabot and Citicard debt - been paying since 2011 - now DCA say pay Ruthbridge, who do I pay?

Hi

 

I have been paying Cabot a regularly monthly figure for many years and now I have received a letter saying that they have passed the debt over to Ruthbridge.  I have read many posts saying that I should not even acknowledge any letters sent to me by Ruthbridge, is this the case?

 

Also should I continue to make my normal payments to Cabot or should I cancel the standing order that I have set up with them.

 

I look forward to some help and support on this matter.

chances are it is a dud debt and unenforceabel and you shouldnt necessarily pay anyone. Tell us who the original creditor was, how old, when was it legally assigned to Cabot and how long have you been paying and do you get annual statements of account that show the amount of debt, payments made and new balance?

You may well end up not paying anyone so the sooner we know the sooner we can advise on the next step

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The original debt was a Citi credit card and I have been paying a regular amount since the 25th of February 2011.  I do not get an annual statement of account.  I think I should have looked into this sooner.

 

Do you think that I should ask Cabot for an up to date statement or just wait.

who says you have to pay it?

is the debt enforceable?

have you ever checked?

a DCA is NOT a BAILIFF and should never be blindly paid on ANY debt.

DCA's like Cabot act like they are the law, even though they have no more power than you or I.

 

It's a sad state of affairs but the best advice someone could have given you back in 2011 was to pay nothing, because it would be long statute barred by now.

 

However, the good news is that it's should now have dropped off your credit file a long time ago, so it's invisible to any future lender.  Also, it's probably unenforceable, just send them a CCA request, wait the prescribed 12 plus 2 days, and when they (inevitably) don't come up with the agreement, you can stop paying them.
