well because i live with my parent, i pay £100 board, phone bill, internet, buy food, clothes, money i owe other debts etc money i owe family, and extra expenditure like birthdays

 

Also when I have completed the form, what should I include in the email I send to the court?

Do I need to group things together- like housekeeping. My outgoings are £100 board, mobile phone, internet, food, clothes, money I owe other debts, money I owe family and extra expenditure like birthdays or going out etc

Looking at Section 7, Expenses and from what you say:

Mortgage - 0

Rent - 0

Council Tax - 0

Gas - 0

Electricity - 0

Water Charges - 0

You have no accounts for any of the above which is why your expenditure is £0 in each category.

 

TV Rental & Licence - you can make an entry here providing you are paying for your own licence or renting a TV in your own name

HP Repayments - if you are making HP repayments then total them here

Mail Order - if anything from the likes of catalogue companies goes here

 

Housekeeping, food, school meals - total what you pay for board, food school meals here - use either a weekly or monthly figure

Travelling expenses - bus fares, rail fares, taxi fares or other costs involved in travelling

Childrens Clothing - what it costs to renew/replace any clothing for the children - make sure you put a figure in here even if only minimal

Maintenance Payments - assume this will be £0

 

Others

This a box where you can enter another 3 lots of expenses, if not enough room then an extra piece of paper will be needed.

Phone & Internet

You can list what you you other family members but unless there is paperwork to back it up it may not be taken into consideration.

 

Section 9 Court Orders

List any other Court Orders here

 

Section 10 Credit Debts

other credit debts - Credit/Store Cards/Loans etc

 

Section 8 Priority Debts

You can put debts you still owe for any of those listed if you are in arrears with any of them.

I have listed my board under rent so that's not correct.

 

Also as I get £204.30 esa every two weeks realistically I come out with 408.60 a month to spend. But when filling out a budget tool it is saying I get £443 a month?

As I live with a parent and pay £100 board, this includes council tax, water rates, tv etc. I buy my own food, toiletries etc. I don't have any children to buy clothes for, but obviously I buy clothes, shoes etc for myself

Without going into your figures, what I will say is that, if you reveal a monthly suprlus figure on your N245 of for instance, £80 per month, the court would not accept your proposal to repay the judgment at £20 per month.

So what do you suggest? Does that mean Any money I have left over I have to use to pay them?

I would have thought you would have been pleased to do so because of course, you want to get the debt paid off?

You shouldn't have extra money. If it is for socializing etc. it should be included in your financial statement under that heading.

ok I have done that. just a question, what if i have other outstanding debts but i have not sorted out a payment plan with them yet?

 

 

 

i was in the WRAG group esa, and i have just completed another medical questionnaire and i am waiting to hear from them. I havent had incapacity benefit or similar

how do you find out if it is statute barred?

 

I took you through this on Sunday. Its an N244 to get judgement set aside on the grounds that it was a default judgement and you believe it may be SB. If the court accept it you then follow a procedure under the Consumer Credit Act that will require Lowell to provide proof of the debt. If they can't provide the required documents then the claim is thrown out.

Hi if you have other outstanding debts which are not currently being actioned. I would ignore them. If they turn up later, you can ask for a modification of your I and E to be accepted if needed.

I have just logged onto my Lowell account out of curiosity and now on my account I am able to set up a payment plan. Before it just used to say that the debt was with lowell solicitors...does this mean anything??

if you want to find out your last payment date

go ring cap1 and ask

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Its certainly a shame that you had not taken heed of the advice that I gave 2 days ago for you to call Lowells.

The fact remains, a warrant has been issued and to avoid a personal visit from the court bailiff, you need to make an application to the court.
