Right. I am now allowed to speak on behalf of my other half in relation to her account.

Had to fax the letter to the specific person dealing with our claim, the infamous Mr Lombardi.

His direct fax number is 01452 638479 if anyone needs it.

His direct phone no. is 0207 1164523. Again, just if anyone requires it and cant be bothered ringing a random first.

 

Apparently, he's off this morning, they're not sure about this afternoon.

So at the latest, ill be ringing with some purpose tomorrow.

Spoke to Mr Lombardi.

No chance of settling yet, as 'we have to treat all our customers fairly, and we're still dealing with cases with hearings scheduled for 9.3.07.

 

In other words, its coming, but not just yet.

He also said, 'we'll nned to see exactly how many charges youve had' so im going to go for all the ones since i started the claim, see what happens.

Ill let him of with the interest on these ones, cut him some slack!

 

Anyone with a hearing on the 9th or before, expect a call today or tomorrow i'd imagine.;)

I think it varies an awful lot in different areas TBH.

Not only how many bank claims they get in, but also their 'normal' workload.

Mr. Lombardi sent a letter out to us this afternoon apparently.

I rang to see if i could tempt him to give up the fight.

Ive told him ill have a read, and get back to him either tomorrow or wednesday, depending on when it arrives.

 

What do we think?? Offer of partial settlement? Or the full whack?

What do you suggest then?

Ring up on the back of the letter and grind him down?

Or write back declining and wait further info?

You may think that sounds strange, but I just let him waffle on for as long as he wanted because he thought he was grinding me down, but he wasn't.

 

I listened to what he had to say and I didn't comment until he had finished, at which point he thought I was going to accept what he had just spent 15 minutes telling me. I simply said "ok that is no problem at all, I'll see you on xxxxxxxxx".

Got home to find a letter on the mat.

 

Barclays disagree with our legal analysis, but they dont feel its cost effective to go to court. Therefore they've offered us £1458.18!!!!

 

The figure is about £30 shy of the up to date figure, and theres no mention of the additional charges weve had since christmas, so i intend to ring 'Tony tomorrow to talk final terms. Also, theres the cr*p about 'the terms of this offer are confidential' which i might just ask him to leave out from the updated letter he'll have to send us... I mean, does he really think ill fall for that?!?!

 

Apart from that though, i can pretty much say

IVE HAD AN OFFER OF FULL AND FINAL SETTLEMENT!!!!

Hang fire till tomorrow for the final chapter, but im close to asking a mod to change my title to ***WON!!***

Hey nice one mate. I've got my court date set for a block hearing 13th april so not too far away. I've got my mate to do me a letter to send Barclays, says i'll be claiming my lost days holiday when i have to book half a day off to go to court. I can smell the money....

Sent my letter on 2nd October, so were within a month of each other at most. I think i might have been a bit lucky with the Court Date though.

 

I've got my mate to do me a letter to send Barclays, says i'll be claiming my lost days holiday when i have to book half a day off to go to court. I can smell the money....

This might be good leverage in getting the additional charges back i think.

Just come off the phone to Tony again.

We agreed on the actual sum, and ive altered the amount accordingly, plus a nominal sum which is going some way towards refunding the further charges since christmas.

I had to waive the right to beginning future litigation in respect to these charges, but made sure that there was a definite time period (ie Dec '06 to March '07) in case we get charged in future:rolleyes:

 

I also added this at the end of the letter, so he doesnt think about maybe dragging his heels on crediting our account:

"I will alert Liverpool County Court to this full and final settlement as soon as my account is credited with the agreed amount. Please contact me on *TEL NO.* to confirm the deposit to avoid further delay in my notifying the courts."

 

Also put a rather hefty black line through the confidentiality clause.

 

Oh and by the way, He's leaving on Friday! I asked him if it was too stressful, but i dont think he found the humour in the comment!!:-D

Money to be credited in 2 working days (ish) he said.

 

Final sum: £1600
