Hi, not sure if i have a case on this but thats why im asking :p

 

I bought some trainers around 9 months ago from Kicks.com who are based in Germany.

 

Some of the rubber started coming away on the back of the trainer so i sent them back.

 

Although 9 months old they had rarely been worn so were in excellent condition.

 

I'm normally very happy to accept store credit but in this case i've been looking at their site daily for about a month now and have not able to find anything i like in my size.

Im a right fussy git when it comes to trainers.

 

I emailed them numerous times over this period politely asking for a refund explaining the above but they have refused.

 

As of last week they are now ignoring my emails.

 

I just rang them today and they are sticking to their guns.

 

Am i entitled to a full refund to my debit card at all?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The store is a bit ropey.

 

 

Im looking around at the moment and a lot the pages don't even load so i cant see a lot of what they offer.

 

 

Id like to get someone or myself something but clothes are out of the question

as i cant afford to be sending stuff back and forth between germany if the clothes don't fit right.

 

 

Im trying so very very hard to spend my money on their site but they just have nothing for me.

Like i said i'm normally fine with store credit.

 

Because the goods were faulty and they were unable to repair or replace

im sure i read somewhere that it has to be a cash refund but cant find any literature to quote at them.

quite correct..

you wont find anything that says you are entitled to a cash refund

nor sadly are you actually entitled to a 100% retail price refund either.

 

 

they are entitled to 'deduct' a for want of a better word 'usage fee'

 

 

that's why I said grab it with both hands as they ar giving you the purchase price

 

 

after whatever period of time [atleast 14 days] its down to the retailer to decide what they want to do with a return under any faulty goods rules they are gov't by.

 

 

you could try a polite letter asking for what you want.

you could if you have it in writing or email

be a bit cheeky and phone our debit card provider and ask for a chargeback.

 

 

however, you do open yourself up to kicks refuting your chargeback

and you'll then be left with nothing

and the bank on your back .
