Hi guys,

I am posting today because, like Mike Parry,

I wish to claim back unfair charges from Close Brothers Premium Finance.

Mike in his case was dealing with them under their old trading name of Close Premium Finance.

I have read the UTCCR regulations and I have also asked the defendant in several letters

to provide a genuine pre-estimate of loss to which they have not;

carving around this with all sorts of information about the terms of the contract in place.

I am no stranger to small claims, having one recently for a reasonable sum of money, so I'm quite happy to pursue this.

I am just wondering what ammo and resources I can gain from here.

There are a series of charges dating back to I beleive May 14, so I know I am within the time-frame to claim.

Also, any interest due, would it be applicable to each and every charge (i.e. Claimable from the date it was applied)

or would it be applied to the total of all the charges. I know I need to represent this figure to the court

Any other help, relating to or not to that of the case of Mike Parry, is heavily appreciated.

Many thanks

I think you should start laying out the detail of your story. You really haven't said very much.

How much money you talking about?

Also, you might post up a link to the other case that you are talking about.

Sorry, Im new to this.

back in December 2015, I saw the case for Mike Parry

and thought I would make a claim for the charges I have faced by the same company.

Attached is 'Letter 1' - my original letter to them.

Further, they never replied to my 1st letter to my correct address, so I had to send 'Letter 2' (attached).

This time I received a letter stating they would conduct an FCA investigation and let me know the outcome

(attached as 'CBPF Letter 2')**, alongside a copy of the letter which went to the wrong address;

also attached as 'CBPF Letter 1'.**

In response to their initial reply I sent 'Letter 3', as attached;

to which I received their formal decision - attach as 'CBPF Letter 3'.**

Since their 2nd reply I have been very busy at university and have not had time to chase this up,

although I am mindful that I would need to reply if I was to utilise the financial ombudsman,

since claims can only be considered for 6months.

I have now sent 'Letter 4', as attached.

See here I am,

the total claim for £445.00 plus interests and costs.

This letter in my view is fairly a letter before action since I have given them three previous opportunities.

I've also attached copies of the change to default fee and the credit agreement.**

I hope that is a little more detailed and gives a better view of my situation?

**These letters are attached in the next post.

Thanks

no you don't need to wait

if put ALL the scans in ONE FILE

of say word

then you can post them all at the same time.

I have removed them as letter 4 has your name and account number on sheet two.

follow the UPLOAD

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
