Hi all, can't find where to put this post so please move if inappropriate.

 

Can anyone advise my next move with this-

 

My father in law paid his mortgage off with the Chelterham & Gloucester around 15 years ago.

 

He sent a SAR with the £10 fee to them a couple of weeks ago

and they've now sent it back, with the fee,

saying they do not hold any records dating back more than six years

and therefore cannot comply with the SAR.

 

We all know these companies hold records going back many years so for one, I don't believe them.

 

But what would be my next move?

Is there a further letter I can send?

 

He remembers having some type of insurance at the outset of the mortgage but doesn't know what it was.

This could be a damn good payday for him if I can get those details.

 

He took the mortgage out in the early nineties and paid it off with a lump sum of £37k around 2001.

 

Any help most appreciated.

yes there will be PPI and prob life contents ins and all manner of other things

that's why they are hiding things

I got over £17k back for my neighbour.

most of it was ruddy skittish widows policies.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Resend the SAR with the payment and a covering Official Complaint letter.

They do have records going back donkeys years so are just frustrating the process by returning it.

Make sure the SAR is asking for ALL information held, including data held in a "relevant filing system" such as, but not limited to, microfiche.

 

The ICO have upheld that these systems are easily accessible for the purposes of data retrieval

Scottish widows..c&G..Lloyds..Blackhorse.....all the same lot.

skittish widows would have done any life etc etc.

 

 

they certainly charged ppi on the life.

 

 

unless it was an endowment mortgage

the only ins that MUST be inplace for a mortgage is buildings

No point trying anything with scottish widows until you know they provided the insurances, for now, concentrate on forcing the sar through.

Just read through the SAR I sent. Although comprehensive, it doesnt include instructions to retrieve archived materials. Ill put this right now and resend tomorrow. Theyre not getting away with anything!

Just an update guys. Amended SAR has been posted back to Cheltenham & Gloucester. Let's see what happens now.

Still waiting for a reply from Northern Rock on behalf of the mother in law. They haven't sent so much as an acknowledgement letter. I guess they are either complying or totally ignoring!!
