I am pleased to announce that my question has, elsewhere, been finally answered the question. Let's remind ourselves:

 

Q - When the proceeds of enforcement are less than the sum outstanding must they be applied in accordance with reg 13?

 

A - Yes

 

So we can finally progress to the second question -

 

Yes or no - When a creditor receives a direct payment from a debtor after they’ve instructed the bailiffs, must this payment be applied in accordance with reg13?

Indeed, yet I am admonished by BA should I not reply to one of her questions. I don't mind who answers it, I just find it strange that no-one is prepared to.
