Hi all.

 

Well what a lovely end to the week!

 

Very briefly...

i went to a local mini retail park on Newport road in Cardiff.

Spent no more than 10 mins in Argos if that.

Put a large box in my car.

Went to Aldi again no more than 10 mins in there (walked out after not wanting to que)

and i come back to find i ticket on my windscreen.

 

Now back tracking,

i work somewhere i have to park in a supermarket car park where im constantly having my car banged and scraped.

when i go to park in the retail park i know im gong to have a heavy box (was buying a desk chair)

so wanted to park as close as i could and when i go to pull in the car in the space next to me is completely on the wonk,

and i just think there is no way im parking close to that idiot so i park over the next line.

 

 

Now i do admit its annoying when people do this.

However i dont expect to get charged £60 for the pleasure especially when its no more than a 20 min time period.

 

What annoyed me most was the car that was parked far worse than i was had been there the whole time

and they hadn't got a ticket.

 

Can you please advise me what to do.

 

If you think its pointless fighting as i was over the line id rather just suck it up and pay the lower fee.

 

But £60!!! Jease

Why would you even consider paying anything? They have no right or reason to charge you a penny. Theyre also one of the lowest forms of PPC there is. They usually get something wrong.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

1 The date of infringement - 01/04/16

 

2 Did you appeal to the parking company - No

 

If yes, has there been any response?

If no, have you received a Notice To Keeper? (NTK) Did the NTK provide photographic evidence? (to early as yet)

 

3 Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) - n/a as yet

 

4 If you appealed after receiving the NTK, did the parking company give you any information regarding the further appeals process? - n/a as yet

[it is well known that parking companies will reject any appeal whatever the circumstances]

 

5 Who is the parking company? - UKPC

 

For tickets received through the post (Notice to Keeper) please answer the following questions. -N/A

 

1 Date of the infringement

2 Date on the NTK

3 Date received

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012?

5 Is there any photographic evidence of the event?

6 Have you appealed?

Have you had a response?

7 Who is the parking company?

 

 

For either option, does it say which appeals body they operate under.

There are two official bodies, the BPA and the IAS. If you are unsure, please check here - BPA

Thanks for that. You are the first to use that template so that is one up to you. :-)

 

I suggest you do nothing until the NTK appears then appeal as the driver. That should appear between 29 and 56 days after the event. Remember, this is a civil invoice, not a penalty so if UKPC want to get their pound of flesh, they will have to take court action and if they do that, they will lose more than the may or may not win.

 

Whilst waiting for the NTK, go back to the site and photograph the signs at the entrance and around where the car was parked as well as the area itself.

 

Don't even think about the other car. just concentrate on your car.

 

Once you have the NTK, we can then assist with the appeal process. Whatever you do, don't fall for any of their bovine excrement

I've had the NTK letter come through.

 

Could you please advise me what the next course of action is.

Did you go back and take pictures?

 

Now is the time to appeal. NEVER mention the name of the driver. Always refer to 'the driver'

 

You can use any reason you wish as UKPC will reject you. Once that is done, they should give you a POPLA code to take it to the 'independant POPLA appeals service'

 

As an example, I would say that as this is a free car park, no loss was incurred. You could mention the other car restricting your ability to park but I suspect that will fall on deaf ears.

 

That is more than you need for the first appeal. Once you get the POPLA code, that is when you go in all guns blazing

can you post up the NTK with your personal details and the ref number blanked out? They have to word it correctly to be POFA compliant and thus create a keeper liability. Gte it wrong and they can only chase driver, who is unknown to anyone.
