Ltter today from DRP :

Notice of intended court action unpaid parking charge £150.00

 

They want payment by 23rd March or court proceedings will take place.

 

What is the recommended action to take?

I need more information how this "charge" was iniatated.

 

And so do we...

 

Date of parking event, Date NTK from PE received by RK, type of car park for starters.

 

DR+ can do nothing but write letters.

Apparently it's a 2 hour max stay and the duration was 2 hours 13 minutes.

Had an appointment with Homebase kitchen planners, they have a computer diary. Also the Homebase employee that I was meeting was late and I had to wait some time for him to arrive. Which can all be proven of course.

Then get homebase to deal with it and get it cancelled.

 

That's exactly what I was going to say. It wasn't your fault that the overstay occurred.

 

PE also make the error that once you enter the car park, you have parked. This could easily take 3 minutes to do so so you then have up to 10 minutes grace period to leave the car park.

 

PE will be unable to prove that you drove around for 3 minutes looking for a space to park.

 

I would go back to Homebase and photograph the signs whilst getting them to cancel it.

After a year you can be sure that this isnt likely to be going any further.

 

 

Ignore the DR+ threats, they cant do anything other than blow smoke

 

 

so the only thing you have to concern yourself with is if PE send you a lba.

 

 

If they do then you say that you wish to take the matter to ADR.

 

 

They wont want that but ultimately have no choice and then you can get all of the rebuttal evidence

 

 

together so the whole thing will cost them money for no result on their part.

Why haven't hombase got this cancelled for you?

 

After speaking with the STORE MANAGER and not the "acting duty manager", (who even identified himself incorrectly as the Homebase manager) I managed to get the store manager to cancel the "Parking Charge". Confirmation from ParkingEye by letter that the Charge has been cancelled.

 

It is the authority of the store manager and only the store manager to cancel Charges (apparently - but who knows now with the Homebase takeover by Wesfarmers - Bummings)

 

Anyway, all good.
