Sunny Loans Help - Now with MMF - default marker issues

Hi all, yet again i need your help.

 

I have acted foolish,

earlier this year i applied for and was suprised to be offered a loan of £950 by Sunny.co.uk, so i took the loan,

then 4 days later paid it back,

 

 

now according to their website you have a 5 day cooling off period where no interest is charged,

although can only use this once every 12 months,

 

 

i paid back and was charged £40+ extra in charges as i recall.....

 

a few days after this i decided hmmm £950,

that would come in handy for this and that,

maybe my credit is getting a little better,

 

 

applied again, was offered £950 again, took it, again....... i know, shame on me.

 

Now the problem starts,

i thought i would be paying back monthly over 10 months, but it turns out then wanted weekly,

i went on the defensive and pulled the plug, running with the £950 essentially,

 

 

fast forward 6 months, the total amount owing is £1450 odd from a initial £950 borrowed,

on CR it is being marked as late payment NOT as a default, not yet anyway.

 

 

I figure i want to enter in to negotiations to pay this back before it hits as default on CR,

can i do this,

are they likely to listen.

 

 

I could maybe afford £50 per month for the next 6 months then maybe £80 per month.

I know this will take forever for it to clear but better than getting a default...

.. or not.

they'll prob default you regardless of what you do.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I will only enter in to negotiations to repay on the condition it is not defaulted, so that is up to them isnt it.

 

That isnt up to you because they will do it anyway.

 

AP markers are just as damaging.

 

We could do with some help from you.

So, i had a Sunny loan, could not pay it back, so Sunny placed a default on my CF,

then Sunny sold the debt on to MMF (motor mile finance)

 

 

Now MMF have e-mailed me saying they are the legal owner of the debt and unless i pay they will place another default on my CF from them,

can they do this,

can i have 2 defaults from 2 companies for 1 debt.

They cannot add another default only the original owner can place the default - where an account is sold/assigned, it can only be updated. The default will drop off your file once the date of the original default has reached it's 6th birthday.

 

Is there any chance you can let us see exactly what MMF have said in their email ?

They cannot add another default only the original owner can place the default - where an account is sold/assigned, it can only be updated. The default will drop off your file once the date of the original default has reached it's 6th birthday.

Thank you. Their email is ambiguous and misleading - there is already a default marker placed - as I advised earlier, all they can do is update it. They are NOT permitted to add a further default.

This is what i thought, and this is what annoys me, why do they have to lie. Ok so on to next question. Can Sunny, the original creditor remove the default placed on CF if i offer to pay in full, as a kind of leverage, you want your money, ill pay all, including all interest IF you remove the default.

It was the first thing i have been accepted for in years, my credit report is and had been shockingly bad for more than 8 years, it is loooking midly better now than it ever has, i have about 5 defaults and 1 ccj on account, i did have more than 12 defaults at one time, i am not proud of it.

Unfortunately, they will not remove the default marker even if you repay in full. That will stay for 6 years from the original date.

 

So they loaned to you despite your credit history ?

Interestingly, i have just looked on Noodle and i can't see a record that any credit checks were ever taken out by Sunny or Think Finance, could this be possible, i did think why did they 'sell' the debt so quick to MMF as its probably only a 8 month old debt.

You could make a formal complaint to MMF - point out that their email is misleading and in contravention of the FCA regulations where they should not set out to mislead a customer. That they should be aware that they cannot register a further default but only update the one that was placed by Sunny.

Could be worth a mention in your complaint in respect of the Default.... you could say, that when you received their email, you checked your credit files and have discovered that no credit history was checked when you originally applied for the loan - that you are continuing to gather information and will then be submitting a further complaint to Sunny in respect of their irresponsible lending !

You could make a formal complaint to MMF - point out that their email is misleading and in contravention of the FCA regulations where they should not set out to mislead a customer. That they should be aware that they cannot register a further default but only update the one that was placed by Sunny.

 

Yes i think this is a good idea, what about the fact i can't see any credit check records on noodle from sunny or think finance, do i have to check the 3 main CRA or is noodle accurate enough.

It might be a good idea to obtain copies of your credit files from the 3 main agencies - you can get one of the £2.00 statutory reports online now, I understand.

IMHO they are not saying they will default the file

they are saying they will place a default marker [i'e a D in the monthly section]

and even if they do default it

its already defaulted by the OC so it'll not harm you anyway

 

as long as the debt buyer does not change to OC's defaulted date they can do what they like

makes no odds.

 

I've moved the thread to the MMF forum.

you'll see that email/like letters are quite common for MMF.

 

they've had their wings clipped now anyway so are pretty toothless..

 

an IR complaint to sunny [provident] is the way to go IMHO.
