I sent my DPA letter on March 30th with a cheque for £10 which they have cashed.

I recieved a letter today offering a 'Goodwill' refund of £39,But they stress that ant future charges will stand and they reserve the right to close the account if it is not managed correctly.

And I have to sign an acceptance form for full and final settlement if accepting there offer.

And if they don't hear from me in the next 8 weeks they will assume i am happy.

 

Cheeky Sods

 

Our claim is not as much as some peoples but its alot to us around £250

 

Any advice etc will be gratefully recieved.

Stick to your timescale m8....reply to them if you want stating that you accept their kind offer of £39, but not in full and final settlement, and that you will pursue the amount outstanding through the courts if necessary.

 

This is the banks way of damage limitation....

I recieved a letter today fromHBOS a Miss L Lumb

 

Telling me me duplicate statements have been ordered and will be sent

seperatly.

 

But they will not be providing information regarding manual intervention on the account because there is no statutory obligation to record this information so they are unable to assist further with my request.

 

So does this mean i should still report them to the information commissioner if i don't recieve them within the 40 days?

 

Also I assume that if they won't detail each charge I can still claim.

Only report them if you do not receive your statements within the 40 days.

 

Withregard to manual intervention;they do not record this because there is none.

If your case goes to court this can not be used as evidence to show true costs of charges.

 

Wait for your statements within the time limit and read around the forum and FAQ to give you more of an understanding of what you are taking on.

 

All will become very clear.

I recieved my statements yesterday aswell as a nice letter that

 

says they are prepared to offer me £109 in full and final settlement.

 

Then the letter goes on to say that my DPA request normally has a £10 charge

 

and also a £5 charge for the statements,both of which they will waive

 

except they have already cashed the cheque i sent them for £10 when i sent

 

the DPA request.

 

Very strange people

Now since the clain is for £188 only,is it worth while?

Do i have to re-send the LBA and amended amount claiming for?

I Got A Phone Call Offering Me £120 Maximum Today,and Was Told That They Obviously Can't Refund All My Charges.

I Was Tempted Just For A Moment But It Soon Passed.

 

I'm Waiting For Friday(payday)so I Can File My Claim At Moneyclaim.

Just make sure you include the full amount at the Moneyclaim stage and have the figures to back it up.

Can you claim intrest on charges for bounced cheques and unpaid D/D's.

 

I'm not sure somethings read like you can and some read like you can only claim interst if you've already been charged intrest like on an overdraft.:confused:

Have you downloaded the exel spreadsheet and put your charges in there?

 

It automatically adds the interest for you @ 8% which yes you can claim when you start the court proccedings

I've just had a 'Notice of acknowledgement'that my claim has been filed and acknowledged by Halifax and it says they intend to defend all of my claim,

should I be worried,I must admit I got butterflys when I read it and I feel a liitle sick.

Terry, I am at the same stage as you. Though, they never actually made me any offers. Just rejected outright. They have ackowledged my claim via money claim four days ago. How long did it take them to settle?
