I am hoping to get this done at last asap

 

 

Registered on MCOL and on POC I have got this:-

 

 

17/10/15 xxxx purchased from xxxx 11/11/15 reported lack of

power/engine rattle - 23/11/15 xxxx

30 minutes diagnostics paid by seller -

timing incorrect and noise not normal -

xx advised 1 and 1/2 hours needs to fully check

timing and adjust in all three places - made

adjustment to help in time they had -

marginal improvement 26/11/15 emailed seller

to request proper repair needed 28/11/15

drove car to sellers garage - claimed could

not find fault on road test

15+18+27/12/15 email to seller with delivery

report requesting proper repair - no

replies 12/1/16 car to xxx as felt could be causing damage – timing incorrect, fully adjusted/ corrected cost £154.80 15/1/16 recorded letter signed for to

seller requesting reimbursement - no reply

29/2/16 recorded letter signed for to seller

requesting reimbursement before court action

- no reply

it all fits in the box but looks a bit messy, is this ok or how should it read? I know it said short and concise but unsure how to do with without all the detail as surely needed?

maybe just needs to be particularised abit more, together with any legals claimed under eg contract/statute/warranty whichever is applicable

Yeah, to be honest ive had some much more important life things going on just recently hence why I haven't been jumping up and down on this.

 

 

I guess there is no time limit on claiming? I cant really think what they could counter claim for?

Could someone help me with the POC please? I realise above I just listed what happened.

 

 

This is the first claim ive had to do although I have done a couple of defences before.

 

 

I am guessing something like:-

 

 

The claimant claims monies for repair costs to xxxx car purchased xxxx date from defendant after the defendant insisted on communication only by email xxxx then ignored emails sent and delievered xxxx dates and also recorded letters signed for xxxx dates?

 

 

Not sure? and is there s time limit to claim by?

i think you wld need to expand a bit, to also mention any relevant legislation and/or contract relied on, to show the cause of the action.

you'll also have to include at the bottom the amount claimed, and any interest if claiming that also.

 

no specific time limit for now, but the sooner the better..
