I have a debt with the above company.

Was originally a barclaycard debt and is for nearly £7000.

all i get is the odd e-mail asking for urgent contact, they obviously dont have my address YET!

what can i do to get rid of the debt?

Thanks

Naylz

in a nutshell

not a lot.

when did you take the card out please?

once a debt is defaulted

the default is there for 6yrs paid or not.

All references to a defaulted debt must be removed from your credit files after 6 years

has passed from date of default, whether paid off or not.

.

{the WHOLE ACCOUNT WILL VANISH, never to return}.

.

{however, this does not mean the debt itself is not still owed

consider a CCA request.}

.

This is so that someone who continues paying something

- even after 6 years from default

- should not be at a disadvantage to someone who pays nothing after default

and ends up with a clean file after 6 years.

NOTE: {the bracketed text is not ICO guideline but my advise]

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

ok so they'll need a signed agreement to get you in court then. as its pre apr 2007 sign up

cca request time?

how much are we looking at here

and is there any ppi or penalty charges flying around in the past?

got all the statements?

Hi Naylz,

Have you sent off a CCA request yet.

Don't worry about giving them your current address - it's probably better that they have it. Otherwise they could issue a court claim at the last known address and they'd get a CCJ against you, in default. The first you know about it would be when you get demands for the CCJ at your new address.
