Hi all

Hopefully this is the correct place to post my problem.Sorry it is a bit long winded but am at my wits end now!!

 

My current van insurance policy began in Febuary with Commercial Vehicle Direct(CVD) and underwritten by Ageas.

In May I received a letter from the motor insurance database(MID) to say my van was not on the database and for me to take action.

I immediately phoned CVD who told me the problem would be sorted out in the next few days so I thought nothing of it.

 

I was pulled over by the police in June during the day because my reg plate came up as uninsured on the police computer.I was held in the police car while they phoned through to CVD to confirm that the van was insured.

I immediately phoned up CVD and was told once again the problem would be resolved.I thought OK its probably an oversight and will get sorted.

 

I came home on Monday to find a government wheelclamping contractors large yellow sticker on my windscreen warning me to insure my vehicle or be fined/clamped/seized.

 

So I phoned CVD on the Tuesday morning and they tell me it will be sorted in 48 hours.

48 hours were up this morning and still I am not on the database!

I phone back again.They tell me it will be sorted at some point in the next few days.

I have phoned Ageas the underwriters today and they have told me I will be on the database by Saturday or the will speak to their IT department.

I really feel I am being fobbed off everytime.

 

I believe it is a legal obligation for the insurance company to register my details on the database and according to the lady on the MID phoneline are subject to a "subtantial fine" if they dont within a certain time.

 

Meanwhile DVLA have issued me with a £100 fine!

 

If my details aren't on the database by Saturday I dont really know what the next step is for me.

CVD and Ageas are not fulfilling their side of the contract as far as I am concerned

 

If anyone can shed any light on where I can go from here I would really appreciate the advice.

 

Sorry for the long post but feeling very stressed by this right now

Talk to the MID people about how to progress a complaint. It would be an easy win with the FOS and you will gain compensation to cover your costs, plus a small amount extra. But CVD should settle quickly to save you having to go to the FOS.

 

CVD should immediately pay you £100 so that you can settle the DVLA fine, but when you pay the fine you should advise them of the Insurers IT issues.

 

CVD should also compensate you for your costs and for inconvenience.

 

From what i have heard before CVD have a history of customer service problems and you should gain their acceptance that you are free to cancel your policy at no penalty, if they cannot get the MID updated by Monday at the latest. You cannot continue with this Insurer, if they are failing to meet basic standards.

We could do with some help from you.

Unfortunately you have done all this on the phone so have no proof that they are aware of the problem. If you had done it by email or letter, you could have sent copies to the DVLA and the bill to your insurers.

 

 

Did they ask for the vehicle details when you rang ?

Thank you very much all who have taken the time to read my post and reply.

I contacted FOS today who were most helpful and are going to put things in motion.

 

However, after checking the MID for about the sixth time today, at about 10pm my van is now registered!!

 

Its only taken them six months to put it on the database !!!

Will not be going any where near CVD and Ageas in the future

I am appalled by this and hope I dont have to make a claim whilst insured with them.

 

On the plus side I have found a great forum here

Keep your (Paper) Certificate of Insurance with you or a downloaded copy from the Insurer's website.

 

If you produce this and the police still seize your vehicle the seizure would not comply with the law so you could then pursue the police force for losses you incur

I'm still intrigued by the DVLA £100 fine. Did you pay it? I wouldn't accept CVD just reimbursing me the £100 because that would mean as far as DVLA were concerned that you agreed you had acting improperly, that your vehicle wasn't insured. Having CVD reimburse the £100 wouldn't take it off DVLA records, as far as DVLA are concerned you were still 'guilty'. I'd be furious about that if it was me. I'd be demanding that CVD provided me with a statement that I had been insured at time DVLA issued Penalty Notice and admitting it was their error it wasn't on MID. Then I'd insist DVLA cancelled the Penalty Notice. The offence DVLA can issue Penalty Notice for is the vehicle not being insured. There's no such offence by the vehicle owner of not being on MID. There's no obligation on the owner, nor can they do anything directly to put themselves on MID. So they shouldn't be penalised if insurer fails to do what they should.
