csa arrears and civil court

hello. ive just received a letter from the legal team from the csa . saying that i cannot take them to court as there is no duty of care

to avoid economic loss and they have stated a case from rowley vs secetary of state 2007.

i am owed 2.300 in arrears from 2012 and have tried several times to get my money now this letter is threatning me with substantial court costs if i continue to take them to court over this matter can any one help. im a carer on benefits .

The CSA provides rights to appeal and to enforce maintenance of arrears and therefore there was no need to place a duty of care on the Secretary of State.

If you are owed arrears, take the non paying parent to court, not the CSA.

 

Unless the CSA collected the money but haven't passed it on to you, in which case go and see your MP, that's what they are there for.

Will it not be the CSA to take the absent parent to court, not the spouse??

Spouses and parents are two different people in as much as biological (parent) and spouse (partner) so it should be take the absent parent to Court...
