Hi could anyone help please.

 

 

I have won a CCJ against the BOS.

 

 

I applied for a money provisions order to register this in Scotland, the CCMCC have cocked this up and just sent a normal Judgement to me but took my £50 for the Form 111 anyway. This is being sorted today so I should have the money provisions Cert on the way.

 

 

My question is; do I really need to transfer this to Scotland if the BOS have branches in England, in fact do they have branches in England? Google'ing this is unclear as they seem to be connected to other Banks in England?

 

 

If so then fair enough, but I wondered. Many thanks in anticipation.

Hi Aidy and welcome to CAG

 

The certificate has to be registered with the Registers of Scotland in the Register of Judgements. This means that the creditor will receive a copy of the certificate which will be signed and then used to take action against the debtor under the Scottish system. In order to action this, the services of a Sheriff Officer would be used. The registration and the cost of application would be payable by the defender.

However, and definitely no offence intended, I was aware of all of the above.

 

 

My question was, if they have a Branch in say London, do I have to go through all that as above? can I not just get a Writ and serve at the branch here in England?

No because it must be served on their main head office.
