Good Evening You Wonderful People...

 

Right... Lets see here.

 

I recently had a good run with you guys in helping one of my work colleagues in dealing with a Private Parking Firm. They are grateful , but its time to turn it up a notch.

 

Another colleague of mine received a Penalty Charge Notice from Croydon Council.

 

She has received it because she entered a yellow box (as shown on page 6 in the PDF) as her lane was clear, however the car on their left pulled out in front of them so they stopped to let it through and then carry on. If they hadnt of stopped there would have been an accident.

 

Now Its been appealed by my colleague directly to the council, however on Page 3 & 4 it dictates their reasons for not agreeing. etc

 

Right, my questions are;

 

- Should they appeal based on what we currently have along with the photos?

- Is there anything important they need to be aware off?

- How often do these succeed in getting overturned?

- Any advice you can offer?

 

Apologies about the quality, it went from Scanned PDF to Photoshop to Word to PDF again...

They really need to look at the video.

 

Looking at the pictures in the document, the one on the top of the page seems fairly clear to me. The lane ahead of the driver in the silver car (which I assume is your colleague) is clear. The vehicle has stopped as another vehicle (the black one) has encroached into their lane. Open & shut case and more than adequate grounds for appeal I'd say

Silver Car is her. I thought that too....

Ive said to her and i said to contact the Cheif Exec of the council. We only have until the 6th June to appeal it.

 

Time is off the essence here.

It seems like a fairly straightforward appeal to PATAS where the council will need to show the adjudicator the video, as that picture (to me at least) only goes to prove the drivers innocence. I'd say, that based only on that picture, the council don't stand a cat in hells chance of winning at PATAS, and providing that the video backs up the drivers version of events, the appeal will be allowed.

Seems straight forward. But they could have been observed giving way to the other car before it entered the lane. Although the image doesn't show this, the video might.

 

Indeed, which is why I added the caveat about the video backing up the drivers version. It might be a bit of an expensive day out if it doesn't, so the driver needs to be fairly sure as to what the video will show. sorry.gif

Today my colleague has sent of the PCN Appeal form to PATAS. However she could do it online! :lol:

Hi Guys

 

Croydon Council sent the video evidence. Ill tell you now, its exactly as said.

 

My colleague had a clear driving line, then someone pulled out in front. They stopped to prevent an accident and then drove on.

 

Whats funny is that the CCTV then spent 20 seconds waiting to get the License Plate number as it was partially blocked.

Croydon trying to make money for the wrong reason.... AGAIN! :p

 

I was going to upload it but, couldnt be bothered to get re-antiquated with Premier Pro.

 

Keep you posted. The appeal is due to be heard 6th July 2015. This is going to be FUN!....

Update as part of the appeals process, the council has sent all the documents (Letters etc) to her and also to PATAS. Lets see what happens. I wont hear back for a while, but hopefully this should be an easy win.

The Appeal was Successful. They didnt send a letter but the Appeals team advised that there was no payment due as my colleague shouldnt have been penalised :)
