If an EA did put there foot in the door or even entered the hallway when the door was opened, what could you do about this, other than ask them to remove themselves from the house ? Being that you would commit a criminal offence (under new rules) if you used reasonable force to remove the EA, you cannot do that any more.

 

There have been posts to forums, saying that Police have arrested people for preventing an EA from doing their job. What exactly is meant by the new laws relating to obstructing an EA in excercising a court warrant ?

 

Using force in return to prevent am EA from making a "forced" Entry is not obstructing an Enforcement Agent. An EA only has the rights and equally the protections of his Enforcement Powers whilst he follows the law. An EA on a civil debt forcing his way in cannot claim to be "obstructed" by the debtor using his lawful right to prevent forced entry, as the moment he attempts to force entry and thus break the law, he loses the laws protection.

 

When it is an EA collecting a court fine, he has the right to use force to enter a property, to enforce his Warrant, either to collect money for a fine, or to arrest someone the Court requires brought before them.

 

From some of the picking on the poor documentaries on TV at the moment it looks like the Courts are spreading the use of these so called "Arrest Officers" for a lot more things - not just bringing in people to explain why they have ignored their fines.
