This is now the second one to kick off for me as i have Mkdp going as well at the moment.

 

This one is as follows.

 

Thomas Cook/ MBNA debt sold off to Arrow global, who up until now have failed to provide any information.

 

Drydensfairfax solicitors have contacted me just before Christmas over this one.

 

I phoned and spoke to them over the matter, and both myself and the party I spoke to agreed the best way would be to send in the cca request and see what came back.

 

 

Sent in the CCA request( Recorded delivery). Which a letter & the postal order was returned Pending documentation from the creditor.

 

Today I have received a cover letter with a copy of my agreement enclosed and demand for payment.

 

Looking at the agreements there is one big issue with all of them.

 

 

All the pages have a wide strip down the middle, and not one is readable. in this area.

Which includes the box with what could be a signature.

 

 

Also other issues which I have picked up, Wouldn't want to say on here, Lol

 

 

Am I right in now going back and saying that the paperwork is of such a bad quality copy that it is unreadable?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I tried to upload them , but I had a real issue with these kept failing and crashing the page.

 

Hopefully you can see what I mean by bad copies, the band goes straight through the documents.

Dx100,

 

 

Please find the Scanned documents attached.

 

 

Did them at work and emailed them to myself.

 

 

I have spoke today to Dryden.

 

And explained that the copies were bad quality,

 

 

which they confirmed the copies supplied to themselves were from arrow.

And that is what is on file at this moment.

 

And could see my point of view and to send a letter to them with in the 30 days from 12th January 2015,

with my objects to the supplied information.

And then we can go from there.

 

Im after thoughts on this lot.

you should NOT ever be talking to a DCA's or their 'fake/tame/pretend' sols on the phone

written comms ONLY.

Don't write to them either at this stage.

 

Illegible CCA means they haven't satisfied your s.78 request. If the account was opened before 2007 it remains unenforceable without a copy of the original. If after, a true reconstituted version suffices - but not an illegible photocopy.

 

Their request that you write is aimed to keep up the pressure on you - and assess from your response how they should deal with you.

 

Wait for their next move.
