Hi

I have just had the same B. O. S contacting me directly and not contacting my DMP provider contrary to OFT guidelines 2.8(d,e). B. O. S

just said when I rang that my DMP had only been authorised to write them not for B.O.S to contact them (RUBBISH).

I rang my DMP they are making a formal complaint to B.O.S and to Inteligent Finance as B.O.S are in house to them.

I would inform CCCS and if they do nothing then report this to OFT.

all the best dpick:)

You can CCA at any time, it's your legal right and if they don't comply within the legal deadlines, use this :D :

Not very, but the only way you can be sure is to send a request to them.

I would put in a £2 postal order. Saves you a couple of pence I believe, and as its the same company they can try and be pedantic if they want but it will definitely take them over the 12+2 working days to get a response from you (right? ;) ).

Remember not to sign the letters and to send it by Recorded delivery so that you can prove it has been delivered.

Keep a reference of the number on the postal order so if any dispute arrises about the payment you can prove if they cashed the order.

Best of british. If you need further help just let us know.

Oooh and by the way, if your current account is with an HBOS group bank it is probably a good idea to open a non-HBOS current account as HBOS have been known to take money out of current accounts to pay off customers so-called debts.

You can try, but I wouldn't hold your breath. I am currently trying to claim back charges on my CC from Bank of Scotland, and they tried to put them back on the account, but I have said "No way Jose, I want it in cash". Wait and see what they send, and if they send you something scan it up, ommitting your details of course and we will take a look to see if it is valid.

  • 5 years later...

I initially had an alleged debt with Halifax, I requested a CCA which Halifax were unable to produce.

The alleged debt was then passed around 6 DCA's,

I sent the original CCA letter off, the alleged debt then moved onto next DCA down the line.

After 6 DCAs the alleged debt ended of the doorstep of Lowell's.

I wrote to Lowell's giving the name and of the previous 6 DCAs and with the correspondence I issued to each.

Lowell's wrote back stating the a/c was "on hold"

I've now received a letter from Lowell's stating:

"I received a final reply from Halifax dated ***** confirming they legally complied with my CCA request"

OK, 2 points

1) Halifax never complied with my CCA request, they were never able to produce a signed copy.

2) Lowell now state as I've received a final response, payment is now required, however, as a Goodwill gesture, they (Lowell) are willing to reduce the debt by 50%.

Can someone advice how I get these parasites of my back, is there a template letter I can use?
