I received a letter from Major law solicitors a few days ago demanding for £2800.

 

 

They say that they act for Nationwide & that they have been referred to a letter sent to me by ARC demanding for the money.

 

 

They are threatening to issue county court proceedings unless i pay up .

 

 

I've checked my credit report can't see this debt (although i think i have seen it on my report in previous yrs)

but pretty sure that next month will be the 6th yr since i last made a payment on what was a nationwide credit card.

 

I'd be grateful for some assistance as to how i respond to the letter. Thanks

Righto, so do you know if the account has been assigned/sold to a 3rd party or is Nationwide still the owner of the debt ?

 

Is the account a credit account or current/overdraft account ?

 

If you cant see any reporting of this debt on your credit files, then it is likely gone past the 6 years from the first default marker - so it COULD be statute barred.

 

IMHO, if you are absolutely certain that no payment or acknowledgment of liability has been made for over 6 years (tack on at least an extra 2 months) then you could send the statute barred letter.. linked below.

If you are not certain, then you should send a Prove it letter or CCA request.

With the CCA request you would need to include the statutory fee of £1.00.

 

Whichever letter you chose to send, you should at least obtain a free proof of posting from the Post office.

Thanks for your response CitizenB.

 

 

I think Nationwide assigned /sold the debt to ARC & now this law firm says that they act on behalf of Nationwide.

 

 

The account is a credit card
