Hi,

 

new to the forum but here goes with an abridged version.

 

Essentially been in a DMP since 2009,

selling my home to pay off and

 

during the tidy up have found some Natwest paperwork I didn't know I had,

it is a loan agreement that has no term of the loan on it

just a monthly amount and total loan.

 

There is also a handwritten note from a staff member saying they have drawn the money down

and will I forward a signed agreement as they will need one.

 

I now know this is not correct and should have been signed first.

 

Additionally I had to pay £15 pm for the privilege of a reduced rate, is this correct?

 

I also found out I had PPI!

never had it never needed it,

only found this out as they wrote to me and

then when I did the sums they don't add up!.

 

Also I cant now get a mortgage as my defaults will be dropping off soon

but for 5 years they have had an account on a status 6 as a late payment

so it will remain long after I pay it off.

 

any information to see if I can claim PPI , charges or interest back would be appreciated

firstly I'd get all the info etc via an sar.

 

any defaulted account

will vanish on the defaulted dates 6th birthday

paid or unpaid

 

as for paying debts off

that wont improve your credit file

neither get defaults removed.

thank you for this,

have completed a SAR request.

 

I am paying all the money back and

 

this seems to make no difference following job losses 6 years ago now earn well.

 

so will be left with a lump of cash from equity of my house,

 

a good income and no home

 

would have been better going bankrupt as paying everything was maybe not such a good idea.

Have you never requested a copy of the agreement vis a section 77 ?

I have now had a response from Natwest to my SAR request.

 

 

They are saying I need to ring them if I want paper copies. and /or email them with the dates I want copies for.

 

 

they are also saying they do not keep details more than 6 years,

which makes me wonder why they have written to me recently about a possible missold PPI from a loan paid off in 2005!

 

 

Apparently if I want copies of phone call transcripts I have to tell them the details of the calls,

ie dates, times, phone numbersm names of who I spoke to

and department involved.

 

 

All sounds very odd to me!

 

 

any advice anyone please??

what do you mean 'as a template'

did you adapt it?

 

 

an sar is a legal request for ALL they hold on you regardless

to account numbers etc etc

 

 

theres no remit for them to filter the info.

 

 

they have 40 cal days to comply

or

you go inform the ICO they are messing you around

 

 

did you sign the letter?

Sorry I meant I used it and then made sure it had my account details in.

 

 

Thank you for that I was sure that they had to comply,

 

 

I will wait 40 days and see what happens,

 

 

do you suggest I write to them again and remind them that I have asked for all information?

 

 

also is this standard practice for Natwest?

its an sar they must comply

 

 

pers I'd ring them and clearly state you want EVERYTHING they hold on you

 

 

as per the SAR which is ICO complaint.

I have today received "some" information from Natwest in response to my SAR request,

 

 

2 credit agreements are missing but forntuately these are the two that I actually had.

 

 

It appears that I have paid 6.700 in PPI that I didn't know I had and according to the agreement copy they have sent me

I have not ticked the box to agree to it.

 

 

The loan was paid in full so can I try and reclaim the PPI?

 

 

additionally the Natwest CC people will not send me anything as they do not have my married name

- but in the bundle is the mandate I filled in with my change of name details that instructs the manager to send to all accounts including credit cards!

 

 

I also do not have any bank statements nor an agreement for the "advantage gold" account they told me I had to have.

 

 

Is it worth me writing again and asking for the additional information?

 

 

Thanks for any advise anyone can give me.

 

 

I also noted that there is an agreement to freeze interest on my loans when I went into a DMP

but they did not do so for another 3 years which explains why the debt did not seem to reduce!

The PPi was added to a loan but I have not ticked the box for it and it seems I paid a large amount for something I did not know I had,

had I know I had it I could have claimed and not got in a mess!.

 

 

Should they also have sent me copies of bank statements,

 

 

I seem to have half bits of information and missing pages.

 

 

this is even more confusing than I thought it would be,

we know NatWest to hold info bak to the early 90's

 

 

what was there excuse . outside 6yrs ?

 

 

you NEED that info if the loans were a chain of refinance

I do not have anything else

 

 

the loan agreement from 2001 is compelte

 

 

but does not state the number of months

 

 

only the amount and

 

 

then the monthly payment and

 

 

they have stated in the end column in ref to PPI "no record".

 

 

Do I write to them again and ask for more information?

 

 

eg bank statements ,

It seems they are saying they only have a record of the one PPI added but I didn't need it I have life and mortgage insurance and got full sick pay from work at the time. They have included no information related to my current account but have included the loan statements but not for the first 2 loans.

 

I hope this makes more sense to you than me, I find it all really confusing, the sort codes are also different on some of the loans, most related to my bank but others to the lending centre and I never dealt with them directly,
