Sorry for delay in replying - have been ill..

 

I am tackling a few problems at once at the moment but with this one - Welcome/Cabot - I found an old SAR but I moved my office space and have lost part of it - so I have requested another fresh SAR from welcome yesterday by recorded delivery.

 

Am I correct in thinking:

 

1. I need to get the new SAR and then go through it with help on here and then reclaim charges?

 

2. It is a secured third charge loan initially with Welcome, then they sold it to Cabot not so long ago,

(we refused to deal with Cabot and have never acknowledged them to date

and we never received an assignment letter etc),

but we are still carrying on paying the monthly payment to Welcome and they are accepting it!?

 

 

Welcome never put a default on our credit file

- but Cabot have done this and the same data is on our file showing all the payments to Welcome,

but Cabot have changed the creditor name from Welcome to Cabot.

So now we have a default on our file history.

 

I didnt think they, (Cabot), could do this?

 

Is is normal for a secured loan to be marked as a default if payments stop for a time etc?

 

I cant help thinking this Cabot make it all up as they go along......

 

Any help is always great.

have you sent cabot a CCA request?

 

 

if not do so.

 

 

yes you need all the statements to get reclaiming.

 

 

I would suspect welcome defaulted the loan before sale to cabot.

 

 

I guess its a bout the same time as that assignment?

Hi again,

 

Thanks for your help.

 

I will check what you say - and get the CCA off too.

 

The SAR will show if and when Welcome defaulted us? Then I can cross check the dates - am I correct?

 

If Welcome didnt defaults us - are cabot in the wrong for putting a default on?

I doubt it would have been cabot

yes the sar should show when welcome defaulted you

as long as cabot don't change that date

it cant harm you further.

I have just checked my credit file on Noddle and it shows as defaulted in 2011 - cabot is the creditor so they have changed it there too .....

 

There is nothing about it on Equifax. So I am thinking in 2017 the default will roll off - even though it still has got behind etc and we will continue paying - Cabot cannot put a new default on - can they?

 

I will get all the SAR and CCA details and return on here as soon as I know what I am up against.

All references to a defaulted debt must be removed from your credit files after 6 years

has passed from date of default, whether paid off or not.

.

{the WHOLE ACCOUNT WILL VANISH, never to return}.

.

{however, this does not mean the debt itself is not still owed

consider a CCA request.}

.

This is so that someone who continues paying something

- even after 6 years from default

- should not be at a disadvantage to someone who pays nothing after default

and ends up with a clean file after 6 years.

.
