My good friend has been chased by numerous DCA's over the last 5 years for 2 credit card debts. One for £1,000 and the other for nearly £4,000.

 

Due to the inefficiencies and disorganised nature of the DCA's we've managed to keep them all at bay and they've now all been quiet for the last 3 months.

 

My friend is now wanting to move house but we're worried the DCA's could issue county court proceedings to her current address and she won't know about it until it's too late.

 

Should we notify DCA's she's moving or just keep quiet?

 

We're very conscious the debts will become SB in approximately 6 months so don't want to miss any correspondence this late in the game,

When your friend moves, she can set up postal redirection for a year, this can then also be extended.

That way any correspondence that could be missed will be forwarded on to her new address.

 

When your friend moves & updates her new addresses with Bank's, Insurance Companies, Electoral Roll etc. This information will be automatically updated on her Credit Reference Files which the DCA's have access to any way.

Has your friend searched her Credit File to see if DCA's are conducting searches?

 

Also, if a CCJ was obtained by default by being served at her old address, then she has grounds to get this set aside, their is a cost for this unless your friend is on certain benefits.

You can always put in place a Mail redirect facility from the Royal Mail. You should be advised by creditors/DCAs that they intend to issue court proceedings.

 

The only problem I can see is that any court papers issued by the court would be returned to them - as with the Benefit agency communications, they are not supposed to redirect those.

Many if not all DCAs run checks when debts in their portfolios are nearing statute barred status so letters are likely to turn up out of the blue.

 

 

Tracing today is so easy and relatively inexpensive so if a debt is of sufficient value the debtor will be traced.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.
