I'm currently having a dispute with Park With Ease over this same car park

and I think there's something that's being overlooked in this thread.

 

that is that there are no signs at the entrance/exit alerting motorists that this is a paying car park.

 

British Parking Association best practice requires clear signs at entrance/exit.

 

I've presented Park With Ease with photos showing there are no signs

but they are not nice to deal with and they just claim there are signs,

whilst refusing to acknowledge or comment on my photos.

 

I think white moss car park is distinct from other car parks along that stretch of road

in as much as I would agree the other car parks are well signed, but white moss is not.

Just ignore them, or if they are regulated by the BPA, appeal to them and ask for a popla reference and then throw the book at them.

I'm not sure if it's that easy to ignore, as potentially further penalty charges may be added.

 

They certainly are very unpleasant to deal with.

 

They've responded to a few emails today alone,

 

yet in all of them they are very aggressive and constantly mention that they are taking me to court.

 

Heavens, my emails to them were all reasonable raising the very pertinent fact that there are no signs.

 

They've claimed there are signs and they'll show photo evidence of them to the court,

 

but they refuse to show these claimed photos to me.

Unless parkwithease actually own the car parks in question, it is highly unlikely they can take any action. From what I have read, they don't usually own the land.

and they are not fines.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

yes !

they are very easily ignored,

and do you really need the photos from them,

take your own make sure your pics are dated.

take you to court !

 

I very much doubt it,

 

once you got your popla code they are dead and buried.

Park with ease are not affiliated with POPLA. they are members of IPC (the other appeals service)

 

While doing a little research, it seems PWE concentrate on the lake district and some of the land may fall under bylaws. I don't think this site is as PWE are charging £50 whereas the Lake district bods are saying that all they can chase is the ticket cost plus a £20 admin fee.

They are not taking you to court as they havent followed the protocols of the PoFA yet

so they cant do court yet without losing on procedure.

 

make them work by appealing stating that there is no signage so no contract formed to breach.

 

leave this stage of the appeal at that and save your efforts for when they reject your appeal

(as they will otherwise how are they supposed to earn anything-by being honest?)

 

As you have the evidence they will undoubtedly just try and pressure you into submission knowing that they dont have the backing of the law.

I have also received the ticket today.

 

. I am pretty sure there was no parking sign at the entrance..

 

. I parked their for 32 mins..

 

. normaly there is free parking period in lake district..

 

. Does anybody know what is the free parking period at White Moss

If byelaws apply, then it's "not relevant land" and POFA does not apply.
