Hi all.

 

This site has been so invaluable in the past, and is currently providing me with key information about a partners debt,

that as soon as I received a letter from the above company, I thought of coming on here for advice immediately.

 

I received a letter from MMF some weeks ago, out of the blue, about un unpaid payday loan.

I knew that this was not taken out by myself and presumed it was a case of mistaken identity and wrote to them to advise of this.

 

They replied with the information regarding the account, dates, amounts and the account number of which the loan was paid into.

This made everything a little clearer, as this was a debt taken out by my ex-partner, on or around the time of the break up.

The account number was hers as I remember it, and it certainly had nothing to do with me at all.

 

Now the break-up wasn't really the easiest for either of us, there were lots to sort out,

and in the last 18 months I've found my current girlfriend, super happy etc etc.

 

I don't really want to drag up an old mess and report this to the Police

(at MMF's request if I felt the details were incorrect)

and I don't want to contact her to get the thing paid, mainly because I know it wouldn't get dealt with.

 

It is on my credi file (shamefully I havent checked my credit file for some months), and I wanted to get this whole thing cleared.

 

The amount of the debt outstanding now is £424.50, the original debt was £125 (original loan amount).

I have explained this in a letter to MMF, everything I have advised before,

explained that I know and knew nothing of the debt and that I can prove of which account number and sort code I had at the time (same as now),

and that I had nothing to do with the account number in question.

 

I also offered to pay the amount of £125 in full and final settlement,

providing that I wouldnt be chased for any further monies,

it wouldnt be passed onto any other company and that any default registered against me in relation to the debt be deleted completely.

 

I have received a letter today, that doesnt acknowledge my letter (sent 22.5.14, their letter is dated 25.5.14),

threatening me with the fact that the account is to be sent to their Home Collections Division within 5 days,

and offering me a settlement of £385.25 (great discount).

 

What would you advise of my next move in relaiton to this matter?

Tiny... Ignore MMF, They think they are above the law. Please do not entertain them...!!!

If you play letter tennis with them, then they will continue to pester you.

 

Trying to prove them wrong doesnt work as ive tried this and they lost my letter i sent to them!

If it is a case of mistaken identity/fraud the onus is on the creditor to investigate the fraud and not you - as per the Fraud Act. Make sure that you may that point very clear to them.

 

Yes its down to the creditor , not you, but if you want to entertain them,then register this with Actionfraud so you can cover yourself.

NO SUCH LEGAL POWERS

don't EVER pay or phone a DCA.

esp at your door

Now I've dealt with these idiots before in your same capacity.

 

Once registered with action fraud, keep a good copy of your paperwork from them.

 

Complain in writing to Rob Sands Or Barry Ellishaw... He is Customer Relations Manager & Compliance Monkey.

 

One word of advice about Barry, he will claim that Action fraud is just a messengers service. Don't be put off by this and stay firm. COMPLAIN, COMPLAIN COMPLAIN To the authorities and MMF.

 

That's if you want to deal with them. If you manage to get this sorted order them to remove the credit entry ASAP. You shouldn't not be held accountable for someone else actions.

Hi all.

 

Thanks for the replies, they've been most helpful.

 

So, I've reported this to Action Fraud, which was suprisingly easy, and I have been given a report reference number.

 

In relation to now contacting MMF regarding this, to ultimately get this thing off my credit file (seeking a mortgage in the coming months),

and having them stop pestering me with idle threats;

 

what is my best way around this,

 

is there a template letter I can send,

 

or any key information I need to provide to MMF to get a swift conclusion.

You need to send a personal complaint addressed to the compliance manager at MMF.

 

MMF lackeys are trained to completely ignore Template letters, and pretty much any letter in general. Thats why you need to hit them high and hit them hard.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

am I writing to explain the situation,

remove my previous offer of clearing the debt dispite the fact it is not my debt

and include the details for Action Fraud?

 

Do I need to advise that they need to stop contacting me and remove the entry from my credit report?

 

Surely they will need proof, or further information from me; names, addresses etc.

Remind him that he has 56 days to investigate and respond. After which you will take further action.

 

Ok, so I just need to write to Rob Sands, advise that I withdraw my previous offer, and demand that all markings on my credit file are removed immediately and no further contact be made to myself in this matter, advise that I have contacted action fraud, and advise that he has 56 days to investigate and respond, after which I will be reporting to FOS?

Be aware that MR sands seems to not be answering all complaints within the timeframe lately. If he doesnt answer yours, then thats more fuel on the fire :)

I'm unsure who registered the default as it just states Motor Mile Finance, the original start date and then the date is was updated, which was January of this year. All seems rather suspect and strange to me. I'll be writing the letter to them tomorrow evening, I think I'll also write a letter to the original creditor also to confirm what is happening.

Thanks for the help everyone. I have generated a letter this evening, ready to be sent recorded delivery to Rob Sands tomorrow morning. As soon as I receive a reply, I'll be sure to post the reply on here immediately. With the help I've received on this thread, and another thread in which everyone is helping out with a problem for my partner; I didn't realise such help actually existed in the WWW!

You also want them to say they will be writing it off, and will NOT pass the debt to any third party or sell it on. They have left that letter wide open so they can still sell it on if they wanted to.

Hi all.

 

I received a letter from MMF this morning confirming that the account is closed and they will not be pursuing the debt. Does that mean they need to remove this from my credit file? Do I need to follow anything up? Thank you all so much for the help!

 

 

 

 

My guess would be that MMF have already off loaded this to another mug before writing to you.

Hi all.

 

Thank you for the previous replies.

I have written to motormile twice since my last post and had no response.

 

My letters have been advising that the previous letter was not sufficient and I need confirmation that it won't be passed on and my credit file updated etc etc.

 

I have today received a reply from lending stream, and would request your further assistance.

 

"Please accept our sincere apologies for the inconvenience you have experienced in respect to your claim

of not having applied for a loan through us.

 

Unfortunately, we were not able to meet your expectations and could not render the service and support you most needed and deserved.

 

We are obliged to have an opportunity to address to your concern afresh and highly appreciate your trust and patience with us.

 

We understand the issue at hand is indeed very delicate, specifically in regards to the adversity with which your credit file has been affected.

 

Unbeknownst to ourselves, your personal information has been misused to obtain an illegal debt, wrongfully affecting your credit file.

 

Hence forth, we assure you that you have complete support from the Fraud Investigation Team at Lending Stream.

 

We have commenced investigation from our end and we have also initiated the transfer of rights to the fraud loan back to our department

from Motormile Finance Ltd. We will be solely handling the case here on, ensuring we have the situation resolved at the earliest.

 

In regards to corrections due on your credit file, T

he lending industry and the regulatory bodies rely on accurate reporting to credit bureaus in order to ensure that correct lending decisions are made.

 

We therefore cannot alter credit entries from customers records manually.

 

In order to proceed with the same, we would require a signed copy of affidavit, validating the reported fraudulent activity,

which would then authorize us to expedite the case to the credit reference agencies to make due corrections.

 

In another possibility, to correct your credit file, you may contact your local police/authorities to issue a Crime Reference Number,

with the help of which, we can expedite the case as well.

 

We are keen on having this issue resolved most amicably.

 

We request for your cooperation and help, so we may together proceed further and make necessary corrections to your credit file.

Now, I haven't reported this to the Police however, as per your advice, I have reported this to the website for against fraud (their name escapes me). Thank you.

Action Fraud?

The letter is a reasonable response imo.

I would suggest taking the letter to a local police station and reporting the as it is at the moment "alleged" fraud it will make a difference to how the case is viewed.
