Hi,

we've just had the second visit in as many weeks from Rossendales.

 

 

My partner DID let the man in last week whilst getting him our contact number.

 

He said he was writing things down but did not ask for a signature, just left a letter for me and

 

today he hand delivered another letter.

 

He did knock but I only just heard it and he waited no time.

 

I have dealt with them before and youll understand my reluctance to start again with them,

 

my financial situation is pretty dire ATM and know that I could offer nothing that they would accept,

let alone the initial payment they wanted even last week..

 

Is it still possible to pay the council direct or do they now have right to gain access and take my goods,

not that that would cover my debt which in all honesty isnt that big but I have no goods of any worth!

if he has not left a levy notice etc

he cant seize any goods

 

is this for CTAX?

It is for council tax.

 

I dont think it was a levy he left last week

 

it was a letter stating the sum the lo was for

and asking me to contact him so that I could pay £120 and pay the rest in anstallments.

 

I dont have that sort of money and know what their payment plans are like

so rather than contact him and enter into a pointless plan I foolishly ignored it.

 

I knew he'd be back today though.

 

The letter he posted today was a notice of attendance.,

 

still offering the option of arranging a plan after a lump sum payment

To set up a payment plan with the bailiffs he will set it high several hundred pounds knowing you can not afford to pay

but you either pay him or I take all your stuff

you will scrape the first months money together the following month when you are 1p short or a day late he will be there and add on a attendance fee around £180 or more

Making your situation far worse

 

He has a liability order nothing else

What notice of seizure has he left

 

DO NOT PAY THE BAILIFFS MONEY DIRECT TO THE COUNCIL

can you answer this tomorrow please:

 

You need to speak to someone at the Council and ask the following questions:

1 - how many Liability Orders they have against you

2 - the dates they were obtained

3 - the addresses they were for

4 - the period of time each covers

5 - how much each one was for

6 - how much is still outstanding

7 - the dates they were passed on for enforcement

The LO wasdated 23/01/14 for the sum of £655.99 for last years council tax. They have come back again today and left paperwork with a form to state income and offer them payments by installments, they have of course already added their £42.50 bringing it to £698.49.

you pay the council direct

 

never enter into a payment arrangement with a bailiff

nor give them any pers financial details

regardin them chasing a CTAX debt.

What good is the phone call if I know the amount its for and when the LO was issued and the year involved? The onlt thing I dont know is the date it was passed for enforcement.

 

People are trying to help you

Do you really think you should reply it that manner

Bear in mind Rossendales have form for demanding details of jobs and finance as they like to go for AOE themselves if they think they can get away with it, so get paying that council direct.

We could do with some help from you.

I am sorry if my post offended anyone; that was not the intention. I was simply asking why it was importantant to know these things not being bolshy but I can see reading it back how I could have come across that way.

Basically it's a standard question list. Sometimes what the Council are asking for and what the Bailiff are asking for are two wide apart figures. It gives us an idea of planning a way forward.

The present position (which will change on 6th April) is that from any money paid to the bailiff they are legally permitted to deduct their fees. Therefore, if the Liability Order is for £200 and you paid £100 to the bailiff company they are permitted to retain £42.50 (if two visits to 'attend to levy' had been made) and they will need to forward the balance of £57.50 the the council to REDUCE the Liability Order.

 

It is for this precise reason that if you are minded to pay the council direct that you also include the bailiff fees that are due at that point.

Right, thankyou. The amount they are actually trying to collect is correct then. Do you think I should contact the council and offer to pay the arrears by installments and see if they will take the debt back or just start making payments when i get some money later this week. I was in a worse situation with them some years ago and have little hope of them taking the debt back though and i think i'll end up woth further bailiff fees on top. If I remember rightly though the bailiffs willpass it back anyway if not collected within a certain time period?

The thing that worries me most is the fact that they HAVE been in my property . I know they got no further than the living room entrance but as I said the fellow was writing whilst talking to my partner. Maybe I would be better off just letting them in and taking my stuff but nothing we have is worth that much.

Sorry to bother everyone again but

 

I'm wondering if somebody could clarify some things for me.

 

As I said in my previous posts,

money has been very tight and I have had little money left

to make even then smallest regular offer of payment to my council.

 

I didthis week manage to borrow a significant amount to clear most of the amount owing to the council

which I paid with the intention of clearing the rest within the next month

as I'm starting a new full time job next week.

 

The day after I made payment online I received a notice of commital letter from Rossendales.

 

If I continue making small weekly payments in order to pay the coucil tax owing

will I still go to court for the bailiff fees which now include the new enforcement stage fee

in addition to the old 1st and 2nd visit fees ?

 

I didnt notify the council that the lump sum was for payment of the arrears

should I also have done this?

They can threaten what they like. It would be up to the council as to whether this goes back to court and this would be very unlikely if you were paying the council. The Magistrates only issue the liability order and then deal with any issue of people deliberately not paying their council tax. They will not deal with bailiffs and their fees. What the council should do, is to settle the bailiff fees due, out of the money you are paying them. So this would leave council tax still outstanding. But some councils won't pay the bailiff companies, where people are paying them directly.

 

Suggest that you write to the council advising them of what you are attempting to do and of your financial position. Advise them that you will not deal with bailiffs and will continue to pay off any arrears directly with the council.

if you are paying

then there little they can do.

 

so have you phoned the council yet and got the answers to those questions I asked before........
