Arden Credit Management chasing debt already being paid to MBNA direct

In 2011 I found CAG which helped a great deal with advice on debt and how to manage the various debt collection agencies that were 'closing in on me'.

 

 

I started to manage my debts paying most of my creditors a reduced monthly payment and had the interest frozen on all but one of my credit cards.

 

Barclays/Woolwich mortgages behaved appallingly and this year after court proceedings were issued I finally sold my flat and moved out of London.

 

I had sufficient equity to buy a cottage outright but only because it needs a substantial amount of work doing.

 

I have kept to my original arrangements with my creditors and since my mail has been redirected they are unaware I have moved.

 

 

This week I began to receive telephones calls from a company called Arden credit management services

to say they are instructed by Idem re: a credit card I held with MBNA to collect on this debt and that I should contact them to arrange payment of all the sum due.

 

I have written to them to say I have made regular payments to MBNA over the last three years

and have had nothing to say this matter has been assigned or given to them to collect money directly

and that when they produce documentation from MBNA to confirm they are now authorised to recover the debt I will pay them directly.

 

I am worried that now I am mortgage free at last my creditors may try to place a charging order on my home.

 

Any advice would be greatly appreciated.

so are this bunch and this debt still on your CRa file?

 

 

if you've been paying your creditors

 

 

you should be getting better than annual statement.

 

 

you did send a CCA request to everyone didn't you?

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi DX

 

I believe this is marked as satisfied on my credit file, and think I may just be panicking re: charge on property, and none of creditors have been cca'd since I had made all the payment arrangements before I found CAG.

 

I have asked Arden to supply proof they are entitled to collect, in addition to a record of all payments and charges added to the account since the agreement began.

Marked 'satisfied' indicates the account has been sold on, the new owner should update the entries with their data, the default date Must remain the same.

For the last four years been making reduced payments on an old MBNA credit card,

this was sold to idem approximately eighteen months ago

although I received nothing to confirm this .

 

I had the usual letters from idem saying pay up or else which I ignored

and I have continued to make s direct payments;

 

 

last November I began to receive phone calls from Arden,

I ignored those too and continued to make the direct payments as above.

 

I have had two letters,

one threatening to send resolve call to my home,

I moved recently and as far as I am aware they do not have my current address,

however, my mail is redirected here;

the latest letter is offering me a discount of £1500 off the original sum.

 

I have not been sent regular statements detailing my payments or the current balance;

I am tempted to respond and ask for their authority to deal,

or should I try to beat them down to a much lower figure and ask for it to be confirmed as a F/F settlement.

 

I had to sell my home in London,

move out and whilst I have managed to buy a property mortgage free

 

 

my income is practically non-existent at the moment and work is sporadic to say the least;

 

 

I am self employed so work is never guaranteed.

 

So far I have not informed any of my creditors of the change in circumstances;

whilst I have no mortgage money is still so tight.

 

At present only Arden are chasing me,

my other creditors are still accepting reduced monthly payments

get an sar off to MBNA too

 

 

get all the statements

 

 

I bet theres far more than £1500 on offer here

 

 

what with PPI and PENALTY [£12] late/over/letter/phone] charges

just what I was thinking,

 

I had written to them at the end of last year to ask what authority they had to collect on this debt, but it never got posted.

 

I think I might write to them ask for some documentary proof they are authorised to collect this debt,

 

ask for copies of statements, detailing payments, there won't be any PPI I never had any on this,.

 

Will write and do a cca request, plus sars.

SAR the ORIGINAL CREDITOR.
