Hi, I bought a Samsung laptop from PC World in July 2012 and after just 16 months the hard drive has developed a fault. I emailed the company and they say they will send someone to collect it for inspection for a fee of £50. If the fault is a manufacturing fault they will fix it and refund the £50 if it is damage caused by use and not their fault I do not get the £50 back. Is this legal?

PC World being the retailer are totally responsible,do not part with 1p.Visit PC World and ask for the fault to be repaired free of charge.They will probably state it is outside of Warranty.Your reply needs to be you require the repair to be done under SOGA (sale of goods act) if they feel unable to do this you require a full refund

 

If you are able Google SOGA have a read,the law is on your side

 

You will need proof of purchase

you may have to get an independent report stating what the fault is and it has developed due to some inherent defect to prove it.

Suggest you take it back and get them to look at it and see what they say. then go from there.

It's generally best practice to get the report done by an independent engineer rather than one working for the retailer themselves.

Politely decline PC Worlds offer on the basis that it would be a conflict of interest for their own engineer to carry out the inspection, then locate a local, independent engineer to carry out the inspection for you and provide a report. You will then be happy to provide PC World with a copy of that report along with a copy of the receipt/invoice for it.
