ACE Catalouge and a default on my CRA file

Hello can any one provide some advice:

 

Ace Catalouge Default they state issued 08.06.13 not recieved by myself.

 

Outstanidng balance £288.04.

 

I wrote to them on 27th of August,

they wrote back to me on the 4th September stating the default was valid and issued 08/06/13

and to send in £10.00 for the file.

 

Completed this today

I have recieved the data protection summary

they state I would have agreed to terms and conditions when opening an account online

and had view of a credit agreement thus they can not send a signed credit agreement.

 

In the account notes for the year there is no entry on the 08.06.13 to sugest a default notice has been issued.

 

There is an entry on the 4th September 13 which states

"sent copy of default noticed issued 08.06.2013)

the copy of the default notice I recieved was a general one not specific to me"

 

Can you advise on the best way forward.

if you mean the copy of the DN in the SAR return

 

then that's correct

 

they don't have to provide an exact coy.

neither do they have to provide ANY copy at all.

 

all they have to do is prove it was sent.

 

so whats the default all about?

 

missed payments?

ok should it not be noted in the account transactions or account summary list

 

are they not required to provide a credit agreement.

 

The account was listed at old address, attempted to get into payment arrangement but to an end they wouldnt set it up on my payment date.

 

However even with redirection I did not recieve a default notice.

One of the invoices I had disputed as all the products did not arrive,

so in effect you didn't pay them for atleast 3mts

and most prob 6mts?

 

thus your cra file prob read 1,2,3,4,5,6

 

if that's the case then the cra system auto marks the account default.

 

the bottom line here is even if you getthe default removed

 

you'll still have the markers as you didn't pay

 

so the debt will still show bad.

 

cant see what you can do here

I would agree with DX . In addition as it seems the account was only opened recently they do not have to provide a signed credit agreement.

 

I would say that they did send a DN to my late wife and when i called to query it (after the remedy date) they told me that it was just a scare tactic. She entered a payment arrangement . Sadly I never got to see her credit file as she died less than a month later

 

After a stinging letter of complaint they wrote the remaining £500 off.

Any opinion I give is from personal experience .
