Sorry for a new thread but i need answers to this one

I am currently setting up a DMP with STEPCHANGE - hopefully this will be completed tommorrow.

However I was just going through my mass of letters and noticed I had missed a default notice from Nationwide for my loan ( Owing £3800 )

I dont know what it is and it says action must be taken by the latest tommorrow

Shall i ignore and carry on with my DMP arrangement or do i need to contact them

I dont really understand what a default notice is

thanks

A default notice is a statutory notice that creditors must send before they can take further action.. eg.. close your account, issue a claim against you.

It should give you a mandatory period of time (14 days) in order to pay the arrears mentioned on the notice.. they should add extra days to allow for postage (2 working days and 4 working days).

The notice should be self explanatory.

If you are in the process of setting up a Debt Management Plan, I would continue with this - StepChange should be writing to Nationwide to advise them of your financial hiccup and that you are requesting more time to pay by way of a new payment arrangement.

You could write to Nationwide and advise them that you are taking professionaly debt advice from StepChange and ask them to cease any collection activity until they have heard from StepChange.

Hi CitizenB

thanks for your help

I will continue with the DMP but Nationwide have given me until tommorrow till respond - Stepchange wont contact them till next week.

Do i need to call nationwide today or just let them do their thing and wait for stepchange to contact them

from the sounds of it a default notice wont make much difference to me

You can if you wish call Nationwide and simply say that you are taking advice from Stepchange and that they will be contacting them next week. You should refuse to be drawn into any discussion about your finances and simply request that they wait until they receive the letter from stepchange.

This happened to me with Nationwide, I was paying them £70pm with my DMP and they transferred my debt to KPR their in house agents and then issued a claim in the small claims court, it was all because in their eyes I wasn't paying them enough.

I didn't enter into payment discussions with them as my DMP were.

I wonder if you should send them a letter quoting COBs just to back yourself up. Oh and I spoke to them lots over the phone, they don't have any of the calls!
