Hi

I'm having trouble with Arden debt management,

 

I've dealt with CCCS (now step change) in the past over debts with HSBC and MBNA,

CCCS put me on a budget plan 2 years ago and recommended I could only afford to pay each debt company £1 a month,

 

Arden have since taken on the MBNA debt

currently £1065

 

I've never not paid and gradually increased the monthly direct debit to them currently £40 a month,

they are saying that's not enough and are refusing to acknowledge that's all I can afford!

 

Up until now I've refused to tell them my monthly outgoings,

but did inform MBNA when I was dealing with them,

when I speak to Arden on the phone they just keep trying to get me to pay more a month,

I'm now receiving threatening letters this morning a final demand one!

 

What are my rights regarding REFUSING to tell them my outgoings and just keeping paying the £40 a month,

I'm ignoring phone calls from them currently about 4 per day.

Hi, you have absolutely no obligation to supply I&E data.

 

Arden like to intimidate.

 

Reply stating that £40.00m is all that you can reasonably afford, and if they decide to escalate the matter you would seek a lower payment level through a court.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

I was thinking of sending them an email. I've blocked there number so it just goes through to voicemail. If I went through stepchange they'd probably recommend I made a lower payment but i want to clear the debt asap so i'm paying the maximum l I can afford.

Just keep the payments up it will look good for you if they decide to escalate.

yes thats why i'm paying by direct debit. up until last month I was paying £11 a months after receiving a letter from them I made an additional payment of £30 and from next month the direct debit i've increased to £40 a month, I explained this to them when on the phone to them but they wouldn't agree to it but still accept payment

They are breaching OFT guidelines by harassing you to make unaffordable payments. Simply advise that your budget will not allow you to increase payments to them and that you are concerned at their continued pressure to prioritise their debt over others on your Debt Management Plan. If they continue, you will be forced to escalate your complaint to both the OFT and Financial Ombudsman.

Hi, you have absolutely no obligation to supply I&E data.

 

 

A creditor is only likely to accept a lower instalment if they can see that said instalment is fair and reasonable - supported by a financial statement which shows that reasonable outgoing costs are listed. If there are a variety of debts then the fincnail statement should show that the payments are being made on a pro-rata basis. This is accepted standard practice within the debt world.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

never discuss your debts on the phone

esp to a DCA

 

they'll say everything to get you to increase your payments.

 

ever sent them a cca request?

 

if not do so.
