Hope I posted in the right area as it relate to a motoring issue,if not admin plz place in right area.

 

I need someone to shed some light on a matter had motoring issue a

nd vehicle was recovered by the police recovery contractors.

 

My question is

when a letter to respond within a 7 days is posted,

does the 7 day period begin from the date of the letter posted

or when served (i.ewhen received by signed post and proof is available)

 

In my situation, letter was sent and received 7 days later.

(i could not respond as the period had already ended before getting the letter by signed post)

 

If someone can shed some info on this and the relevant law.

vehicle removed by constabulary under s99,

 

recovery agents sent a standard notice to dispose with no dates marked on letter

, letter arrives by recorded post and signed.

 

now interesting bit was I had to respond back within 7 days to arrange collection or contact

 

,responded back on 7th day of receipt of letter.

 

received letter back saying

'vehicle disposed on xx/xx/xx (which is 3 days after receipt of letter) as no contact was made within the 7 day period as in letter.

 

made contact back and this constabulary period starts the day the letter is generated ( in black and white).

 

now what they were not expecting was I kept the envelope with sorting office markings (time and date),track numbers,track proof delivered.

 

now I have forwarded all this forward to them and are still trying to fob me off, so just waiting in black and white to arrive.

 

I am now compiling a file so I can take the matter forward(courts)as there is a major flawed in the system for vehicles recovered

.(in other words its impossible getting the vehicle back)

 

If any one has any experience in this, send us a private message

 

btw

this is so behind curtains because the innocent motorist does not realize what's happening as 99.9%

,its the vehicle owners insurance that pay out not understanding what has happened.

 

IMO it will be the motorist in these categorizer that may get affected:

 

vehicle stolen and found by constabulary abandoned

vehicle broken-down and removed by constabulary

when recovered under s99 and motorist has no interest in claiming vehicle

need some info as to proceed further..

had my appeal considered by the local force and its been partially upheld on certain aspects,. there's no further appeal process. I want to claim my losses and have the appeal reconsidered as I still believe its not been fully investigated.

will the next route be small claims?
