      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have got a payday loan with payday express that I cant afford to pay, I emailed them a break down of expenses and told them that due to restructuring at work I am no longer able to repay the loan and could I set up a repayment agreement.

 

I initially emailed them on 19th August and all I have had back is generic emails asking me to telephone them about the account.

 

After getting nowhere and getting sick of emails from them (the amount owed keeps increasing despite me asking them to freeze interest in the initial email I sent them) I decided to phone them (I know you will all yell at me for this).

 

They are now saying that to consider a repayment plan they need proof of the restructuring at work, are they allowed to request this information.

I thought that, what would be the best way to get the repayment plan set up, as they are gonna keep requesting this information when ever I contact them, is there a piece of consumer legislation I can use against them or should I just refuse under the data protection act and confidentiality at work

Have a read of the PDL survival guide and how to make a complaint to the Financial ombudsman if you believe you are being treated unfairly.

 

Have you cancelled any CPA with your bank ? Once you have advised your bank that the company no longer have your permission to withdraw money, they must honour that. If payments are then made, they must be automatically / immediately returned.

i am in a situation where I am not going to be able to pay my pay day loans, so after reading many threads on this site. I rand my bank to cancel the CPA on all seven of my pay day loans! I was told there isn't any on the account and previous payments were classed as one offs!!!! Have you come across this before? I have cancelled my debit

card and am hoping that will be enough to protect my money!

Forgot to mention earlier and this may change the whole situation.

 

This is the email I received from them that prompted the phone call

 

 

Dear Paul,

We have now written to you and tried to contact you on a number of separate occasions and have yet to receive a satisfactory response or resolution to your outstanding debt of 568.2 with Payday Express. Please be advised that repayment may continue to be attempted at any time in accordance with the terms and conditions of your Loan Agreement.

 

Please be aware that as your account is in arrears, information will be passed to a Credit Reference Agency. This information will stay on your credit file for at least 6 years and this could affect future borrowing with other credit providers such as lenders, mobile phone or TV providers.

 

In an attempt to have this matter resolved, we may be prepared to consider a discount on the principal balance providing you make contact with us in the next 7 days and/or agree a suitable repayment plan thereafter.

 

In order to update your debit card details or make a payment to settle your balance you can logon to our Account Management area using the link https://applications.paydayexpress.co.uk/AccountManagement/a/Login however if there are any changes in your financial circumstances and you prefer to call then please ring us on 0115 908 1162* where one of our advisors will be happy to help.

Yep I did same, hoping that is enough to stop them taking anything, but looking through this site it would appear that on occasion they can still get money! Bit worried but nothing new there! Going off what other people have put, it would some seem that any reasonable offer which is not accepted is against all the guidelines and regulations. But on the other hand they don't seem to care! I am expecting a lot of stress I the next few weeks

Yes, once you have advised them of a change in your financial circumstances, refusing / ignoring requests to enter into a sensible repayment plan, would IMHO, be considered unfair treatment.
