Good Afternoon CAG,

A customer has provided me a Dell Laptop to repair.

The fault is most certainly a failing hard drive.

Having done the usual diagnostics and attempted recovery it is very likely the drive will need replacing.

The laptop has 1 year collect & return warranty on the laptop which expired mid July 2013. The fault was reported around the last week of August.

The Laptop was purchased from Tesco Direct in April last year.

Do you think I have a claim under the sales of goods act?

I am happy to replace the drive in the laptop as is the customer as they need a quick fix.

However I don't want to charge my customer unnecessarily if a replacement hard drive can be provided OR claim under SOGA.

As the laptop only had 12 months warranty, it's a pretty poor show that it's failed in month 13.

Considering I have other laptops here that have been running fine since 2006 without too many problems.

Any advice appreciated.

Thanks :-)

def a soga claim.

NOTHING to do with any warranty

you should find that any Tesco store will honour the fault repair.

Thanks dx. On the ball as always

So if I took the laptop to a Tesco Extra store they'll honor a repair on it for the customer? When customer spoke to them last they wanted £130.00 for the repair. Errr. No!

Also the customer may no longer have the receipt. Am I to assume that therefore he slightly scr*wed??

its worth a try

or ring them up

if the OP paid by a card then all that is needed is some proof of purchase

though by their system they can search bythe serial number etc etc.

poss ask Tesco direct online how they propose to resolve the matter under soga/dsr.

Customer doesn't remember but he suspects it was delivered.

I've sent Tesco an e-mail asking if they would like to resolve but unfortunately the customer has asked me to proceed with the repair. So I've said I'll order a like for like replacement and pursue with Tesco on his behalf if necessary.

Still don't feel right charging them though :\
