Hi Folks,

 

I had sent Amex £1 and requested CCA. They responded by saying chargecards are not regulated CCA.

 

I then asked the DCA in question the same question and they have now sent me the below attached application form purporting to be the agreement but there are no T&C.

 

The application is a very poor quality yet they are threating me to court if I don't pay the DCA.

 

Is this application form enforceable ? please advise as I don't remember ever signing an agreement back in Feb 2006 with T&C.

 

I have also asked the DCA for default notice, termination notice but they are not able to comply to my request apparently.

 

Any advise on Law in regards to charge cards with prescribed Terms ?

Who is the dca?

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi DX100uk,

 

Newman is the first DCA to chase for this debt.

 

There is an on-going dispute with a retailer in which I cant say to much as they peruse these sites. The amount in question hadn't been paid since August 2012.

 

Yes I have checked with CRA and there is an entry by Amex of default but there is not default date as per below: Company: Started:AMERICAN EXPRESS 01/01/06 02/06

CHARGE CARD £700

Account Type: Balance:

ARRANGEMENT

Start Date: 05/13

 

Amex have refuse to give me info however the DCA told me that the charge card was cancelled in 9th Dec 2012.

 

All Amex are saying this agreement is not regulated by CCA but I think something is wrong as they keep threatening but not taking any action and all they have is an application form for chargecard rather than agreement with prescribed terms and conditions.

IMHO, an application for something doesn't actually mean that you then entered in to an agreement.

 

You can obtain information by way of a Subject Access Request to Amex and they are obliged to comply by providing ALL data they have in respect of your relationship with them, within 40 calendar days. It will cost you £10.00.

 

I will have a look and see if charge cards are regulated.
