Advice Please - Strong suspicion that my signature has been added to copy of Natwest credit card agrrement

Hi,

 

I'm really disgusted with myself as sent request under s78 with my signature on the request letter.:doh:

 

I'd sent for the info re a Nat West credit card that I have being paying off under an agreement made with them in 2006/2007 due to being contacted by Triton DCA.

 

Really accommodating letter back from Natwest!! stating,

 

"...the 'true' copy requirement can be satisfied by providing a copy agreement at the date the card agreement was made...".

and guess what, copy came with copy stamped on to it and with what looked at first to be a true signed copy.

 

After a few weeks and looking at it again

 

I've realised that the only writing on the form in my handwriting, is the signature (even the date of signature is not my handwriting).

 

I do have an upward slope on the last letter of my signature,

but when asked to keep within a box,

i do so or only slightly go over the border,

this signature rise like a banner out of the box and well into the 'declaration and authorisation' paragraph.

 

There would have been no reason at that time, 2004, that i would not have been able to complete, what is a leaflet type application form, in my own hand.

 

Do I have any recourse to go back to them with my suspicions?

I take it this has come back from NatWest, or their in house DCA triton?

 

if it says copy, then it must be a photocopy of the org you signed, so, is compliant

 

what about the terms and conditions?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

My belief is that a cca request does not even have to include your signature. I also have agreements with copy stamped on them. If you look at the key financial information is everything correct such as the charges for late payments.interest rate etc.

Have you also got t&cs. from inception and again from default/current. Is the balance of account accurate.

The only way to demonstrate it is a cut n paste job would be if you had a copy of the request you sent so that it could be analysed.

To accuse them of forgery you need to be very very certain of what you are saying.

Any opinion I give is from personal experience .

Hi,

 

Again copy stamped on terms & conditions, they do appear to be from 2004 as, 04/INWTC-4, is printed at bottom of last page of T& C's.

 

Still can't understand why i wouldn't have completed this application/agreement form myself and there are on e or two overwritten items, where a figure or letter as been input and them corrected.

Hi fletch,

 

I don't think I want to go down the route of accusing them of forgery, just feeling very niggly that they have used Triton and was hoping there was something to beat them with.

 

I think basically it's coming up to 6yrs and default will be falling off my credit history. I continue to pay the agreed payment to Natwest and will be writing to Triton to say as such and that after looking at my financial situation,( won't be sending them I & E form), i might have to reduce that amount.

You are aware that Triton are just Natwests inhouse DCA.

 

Not sure if the default time is really relevant as it's not as if its coming up to SB

In all likelyhood just a clean up/review of files and move from one department to another

Any opinion I give is from personal experience .

Wasn't aware that Triton was Natwests' in house DCA, but did feel that as my defaults will be falling off credit reports at end of this year had some relevance as all of the creditors I had to make agreements with at that time are suddenly coming out of the woodwork.

Think I will just wait and see how Triton respond to me; if they start to get nasty and don't agree to continuation of my agreement already made, I'll look at what actions I have available then.

Stokes, I popped "forged signature" into the search engine and loads of threads popped up. However this one is closer to home for you.. Nat West and they even admitted that this had happened. :)
