Hi,

I'm 2 months into my 6 month agreement with Halifax regarding my credit card (I have written confirmation).

They agreed to my paying 5quid a month which will be reviewed once the 6 months has passed.

I've made both payments on time.

Last week a receive a letter from Blair et el (in house debt collectors of HBOS) asking me to call their offices

to either make full payment or discuss my payment options and that if I don't call they may do a door step visit.

I've done some research and have found a template warning against them doing the door step visit

but needed advice on what I should say regarding my debt.

I've penned a letter saying that as there is already an agreement in place the terms of which I have kept I will not be calling them and that I will only liaise with them by letter.

Will this be sufficient for the time being?

Do I continue to liaise with Halifax card services or Blair et el from now on?

Thank you for any advice anyone may have.

If there is an agreement in place with the Halifax then Blair, Oliver cannot change that until the review date.

They are only in house collection agents, so you might want to point out to them that

1: There is an arrangement in place with Halifax for which you have a written agreement and that you have been maintaining.

2: There is no change in your circumstances anyway

3: That you believe their communication is an attempt to bully you into increasing your payments to an unaffordable amount.

4: That you do not discuss your financial affairs on the telephone

5: That they are in breach of OFT guidelines and you will be making a complaint to the OFT.

Thanks for your advise citizenB. I did suspect that their intentions would be to try and force me into increasing my monthly payments.

At the end of the 6 months should my circumstances still be the same will I need to approach them again (Halifax card services or Balir et el) with a letter explaining my situation (again) along with a budget sheet in order to renegotiate new terms? Or keep up the payments until they contact me?

If your situation remains unchanged at the time of the review, then IMHO, I would wait until they contact you - then simply respond by advising your circumstances are unchanged. If you have already supplied them with an I&E then there is no problem with supplying an updated copy, even if it still shows that you have no more to give.

A little advice if you do have to send another copy at the review stage - you should allow a safety net of at least £25.00 to cover you for any increases in priority spending such as utilities / food / fuel, during the period.

I am given to understand this is acceptable.

When writing to Blair Oliver, always obtain a proof of posting from the Post Office - at the very least you can get the free one if you can afford it, then go for the Recorded Delivery and keep the receipt with your copy of the letter.

I definitely intend on sending the letter recorded. Had some issue in locating an address as their letter only provides a phone number. I managed to find this address,

Blair Oliver and Scott

Dundas House Viking Way

Rosyth

Fife

Scotland

KY11 2UU

Which another thread author used to correspond with them so will give this one a try. Would you suggest my sending a copy of my letter to Halifax card services department as well?

Send a copy of your letter to the Halifax Head/Registered office - that way it will get to the right department.

The Address for Blair Oliver does look correct.

Are you saying there is no address on their letter to you ? They are obliged to put their registered office address on their letters at the very least.

Just checked there is a P.O Box address at the bottom of the page. It's my understanding that recording letters doesn't work for po boxes. Is that the case?

That is correct, it is a waste of money sending a Tracked letter to a Post office Box address. I think the address you have posted above is their Head Office address, so that should be ok.

Yes, it is.

Their collections address, strangely enough is the same address.. but PO box 66 !!

  • 4 weeks later...

Hi all,

I wanted to give an update regarding the above matter. So the penned letter was sent to Blair, Oliver & Scott and a copy sent to Halifax. Attached is the reply I received from the Haifax complaints department.

It goes like this (see attachments)

So all in all I've had a result and am 50 quid in the black which I quickly removed from the Halifax account and put in a safer place (lol)

Will update this thread if I have any problems renegotiating my payment plan (or should I start a new one?)

Once again thanks for all your help citizenB

**edit** just had a look at my letters crop 1's text is very small don't know if it can be viewed.....the second page is fine
