  1. I had a letter of claim and submitted a CCA request. Those are the documents they sent.
  2. Thanks. I’ve not had a default notice, payments stopped in 2018. Should I advise them they didn’t provide all documents requested or go back to ignoring? In your experience are they brave enough to go to court?

  4. Bundles go 1-8 then 9-18 both have the duplicated pages 1-2 & 9-10 with my signature dated 2005. No signature on behalf of bank. I rescan and try to get a better view of the blurred page, the font is far smaller than on the others.
  5. I have no idea if or how I compressed it in the first place. Should I try again? There are two sets of documents. One starts with the personal details page followed by points 1-23.6. The other starts with personal details followed by point 1-17.6.

I submitted a CCA request in October 2022 receiving a package of documents in February 2023 providing a copy of the signed credit agreement with Halifax dated 2005 along with some of the statements of the account. I believe the statements provided are incomplete as they start several years after the account was opened and doesn’t include the payments made after the card service was withdrawn and once the debt was sold nor included default notifications. Overdales cover letter states if I wish to dispute the matter to provide further information or any evidence which will support my dispute. To kindly note they are able to accept an affordable payment offer and they require me to make contact with my intentions towards the matter otherwise they may request a CCJ. Further advice would be appreciated. Thanks
  8. Thanks! Should the letter be addressed to Overdales or Lowell and sent to a PO Box address? I would feel happier tracking the letter but cant do this to a PO BOX. Any advice?
  9. ***UPDATE*** I have now received a ‘Letter of Claim - 30 days to prevent legal action.’ Included is a reply form. Section 1: Do you own the debt? Section 2: How will I pay? Section 3: Do You Intend to get debt advice? Section 4: What documents are you sending or requesting? Inc. financial statement. Is this the point I engage?

  11. Hi, Like most people here I'm looking for some advice and haven't found a similar question already posted. I ran into financial hardship in 2012 and struggled to meet the minimum payments to a Halifax credit card. That same year service was withdrawn by the bank and I entered into a peppercorn payment plan that I paid for a number of years. After sometime the debt was sold to Lowell and I actually #cringe continued to make payments. In 2018 I wrote to them explaining I wouldn't be working due to health complications and made them a full and final payment offer which was rejected. They wanted me to raise my payments even after I provided evidence I was in the red at the end of each month and living off of support. At that time I was fed up, felt harassed and stressed so wrote back stating that I've tried to work with them its going no where so I'm not making any more payments and I wont be corresponding with them again. Over the years since this they'll periodically write and I'll ignore. I did move, they found me and started sending letters to my new address. I've had several we're considering referring to solicitor letters from them. Last week I received a 'Notice of Acting' letter from Overdales Solicitors. As per advice here I'm still inclined to ignore unless its a 'Letter of Claim'. Over the weekend I did a credit check and there's no defaults in relation to this card, its not even listed as an old account. Could it have been removed because of the age of the debt? Is it possible they could still legitimately take me to court for this balance or are they trying new scare tactics for me to make contact? You're advice and experience would be appreciated.   12. Hi all, I wanted to give an update regarding the above matter. So the penned letter was sent to Blair, Oliver & Scott and a copy sent to Halifax. Attached is the reply I received from the Haifax complaints department. It goes like this (see attachments) So all in all I've had a result and am 50 quid in the black which I quickly removed from the Halifax account and put in a safer place (lol) Will update this thread if I have any problems renegotiating my payment plan (or should I start a new one?)   14. Just checked there is a P.O Box address at the bottom of the page. It's my understanding that recording letters doesn't work for po boxes. Is that the case?
  15. I definitely intend on sending the letter recorded. Had some issue in locating an address as their letter only provides a phone number. I managed to find this address, Blair Oliver and Scott Dundas House Viking Way Rosyth Fife Scotland KY11 2UU Which another thread author used to correspond with them so will give this one a try. Would you suggest my sending a copy of my letter to Halifax card services department as well?
  16. Thanks for your advise citizenB. I did suspect that their intentions would be to try and force me into increasing my monthly payments. At the end of the 6 months should my circumstances still be the same will I need to approach them again (Halifax card services or Balir et el) with a letter explaining my situation (again) along with a budget sheet in order to renegotiate new terms? Or keep up the payments until they contact me?
  17. Hi, I'm 2 months into my 6 month agreement with Halifax regarding my credit card (I have written confirmation). They agreed to my paying 5quid a month which will be reviewed once the 6 months has passed. I've made both payments on time. Last week a receive a letter from Blair et el (in house debt collectors of HBOS) asking me to call their offices to either make full payment or discuss my payment options and that if I don't call they may do a door step visit. I've done some research and have found a template warning against them doing the door step visit but needed advice on what I should say regarding my debt. I've penned a letter saying that as there is already an agreement in place the terms of which I have kept I will not be calling them and that I will only liaise with them by letter. Will this be sufficient for the time being? Do I continue to liaise with Halifax card services or Blair et el from now on? Thank you for any advice anyone may have.

  19. Hi, I'm in the process of preparing my budget and letters to send to a credit card provider who's minimum payments I am know longer able to meet. I do this in the hope that they agree to freeze interest and charges as well as accept reduced payments until my situation changes for the better. I still have a few questions. 1) I had another credit card that had a zero balance on. During a family emergency I lent it to my sister and she has charged approximately 1,000 on it. She is making the monthly payments on this card and reducing the balance. I'm wondering how or if I should include this debt on my budget, if so how do I go about explaining that I am not the one making the repayments? 2) Should I not make any payments towards my credit card debt until the bank has agreed to my proposed reduced payments? 3) Would it be realistic to say in my letter to my credit card provider that I wish for the reduced payments to be accepted until my financial situation improves or should I set a review date for 6-12 months later? Would it be cheeky to say until the debt is repaid even if it means in 40 years time? Sorry for all the questions. Unique
  20. @CitizenB, I am not on the electoral roll at my Brother's address. I have notified my creditor with my change of address but not the fact that I am know longer living in a home owned by me. I have not applied for any credit since living at my brothers house. Only for a new bank account as my debt is with the same company I bank with so don't want any issues to arise once I get the ball rolling. @Cerberusalert @Brigadier2jcs, that's great news. Thank you.
