The regulatory body already shut down the old parent company of TFF, however the owner knew what was going to happen, so he transferred the company to another one of his companies, and went into hiding.

 

If you did a google search on him, you would be amazed at what he has gotten up to. Not to mention the address that he uses to get around the law and still uses as "contact addresses".

Its like the bodies are on a wild goose chase. Theyll just close them all down hopefully just that surely they know what he is doing - the guy should be jailed - people have gone down for much less.

Hi Guys,

 

Heres an update, after another email from Marshall Hoares Bailiffs saying they were sending foke round to my place i sent a kind email back telling them where to stick it!! I contacted to financial ombudsman who have now written to them on my behalf, i also filed a complained with the OFT, the guy i dealt with at the OFT obviously knew them well and has taken a witness statement from me. I would suggest that any body who would like to follow suit drop him an email to file a complain at Moussa.Zabeti@oft.gsi.gov.uk

 

I have to say thanks to the advice on this forum i have followed and have only seen positives, TF, NDR and MHB threats to me mean nothing and as when sending them emails using words such as the OFT seems to scare them and all of a sudden fees are dropped and charges are reduced, however they still try to take the pi$$ a little bit. Dont cave stick to your guns and make sure you contact the FO and OFT. I will post an update to let you know how my FO letter goes down with them and what the result is.

wont surprise me! with the few payday loan companies i have dealt with these guys (toothfairy) are by far the worst i have dealt with, probably the worst company all in all i have dealt with! The are attempting to use legal loopholes and oversights to their advantage.

The entire PDL uses legal loopholes and oversights to their advantage. There are no real laws that govern the industry, just guidance. Interest in the UK is also uncapped which allows them to charge extortionate rates.

The entire PDL uses legal loopholes and oversights to their advantage. There are no real laws that govern the industry, just guidance. Interest in the UK is also uncapped which allows them to charge extortionate rates.

 

Im not against Payday loans as such, and users will have signed up to the agreements etc so we are also 'at fault'.

 

What I am against are organisations like MHB/Toothfairy who threaten, harrass and use dirty tactics to charge extortionate charges etc. That is the crux of the problem. They are threatening people and using tactics that allow a loan to rack up charges then contact someone and all of a sudden they owe £5k on a £100 loan. That should be illegal.

I dont understand why there is a lack of regulation - guidance is just a framework i.e. best practice so to speak. I agree there ought to be regulations so the question is - why has it taken so long?

 

I read in the paper today that theyre thinking of shutting down PDL not sure how or why - just put in stern regulations especially about debt collection in order for it to become more robust and not to let these PDLs get away with murder

After a stern email telling them that I consider this matter closed as I have attempted to resolve this situation via email three times - I recieved a more tailored response from MHB today (when I say tailore d- its not much and still has a standard reply but has a bit more) they accused me of using an aggressive tone (ER HELLO you have been threatening me for months) and that I have not attempted to resolve this (ER HELLO I have tried to resolve EVERYTHING - except they want it by phone I want it by writing) Out of interest can they accuse me of not trying to resolve this if they have called me but I have not picked up? I have sent written communication however and have all the evidence to prove this requesting that they resolve this matter only via written means.

Report mhb to the oft. Remember, they are not bailiffs and are toothfairy under a different name.

Im going to annoy you again I know.

 

I had a look at my credit report today and didnt realise that a default is rolled over so to speak. By that I mean for the past year and a half since the original default (which I am going to put a note on my account for) its a recurring default so even this month it has come up as a default - are they alloweto do that? roll it over? So it appears that my default is this month rather than a year and a half ago.

A default will clearly say DEFAULT on the status of the debt. If it is a default, and theyre changing the date every month, they are in HUGE trouble.

Its not a late payment marker. Its a red D marker that is recurring on a monthly basis - is this correct? So it reads as if I just defaulted this month...

 

Firstly I did pay the amount but was disputing the total amount i.e. the ridiculous charges which shot up to £800 and now to £3k so they defaulted me. Secondly they didnt even send me a default notice or a notice of default which, doesnt hold up im sure as it would be a default, wasnt a default as I had paid the amount just not the £3k which im sure is increasing as we speak.

 

Its annoying because it seems I have no control over my credit entries apart from notices of correction etc. If I "defaulted" in January 2012 why is it continuously appearing for the past 18 months? ie. June 2013.

 

You say theyre in trouble and thats not allowed - how do I complain? I know im venturing on the credit reference agency forum here

Can you post the entire entry here please. Make sure to edit out any names and reference numbers. I think you may be right here. Check the STATUS of the debt, not the marker under the date. It will clearly say DEFAULT if it has indeed been defaulted. If it does, and they are changing the dates, i'll ask someone to come in here who can give you an amazing letter to send to them, and if that fails, you could take legal action on them.

The report does say date of default in June 2012 so im presuming they are 'correct' albeit they never told me they would default me. At the time I was disputing the amount - is there anything I can do to state that I paid the loan off its the charges they are defaulting me on - or will I have to do a notice of correction?

Ahh i understand now.

 

 

The debt is marked as default, dated june 2012.

 

So each month they update the status to read as a default and they keep the original default date. This is normal and is just a up to date reflection of the account. Once it is paid off or you negotiate a settlement, it will read settled or satisfied. If you have a repayment plan in place, it should state arrangement to pay.

 

You can tell the CRA's to add a notice of correction, but they will contact Toothfairy and if TF say its accurate, then the correction will be removed. Thats why a full complaint is needed to TF, but it would be pointless doing so as they pretty much ignore all communication like that.

Ok I understand now - my error in the first instance.

 

So actually unless I deal with TFF directly there is not a lot I can do? especially as I paid off the loan. Its a bit of a nuisance that us mere mortals have no control over Credit reports (apart from actually paying off the loan I suppose)

I think ill complain to the ICO - nothing to lose and everything to gain.

 

I did pay off the loan - just not the charges of £800 which had risen whilst I was disputing. Like I say theyre defaulting me on the actual charges. This is why althis is just absoutely ridiculous - I still laugh thinking about this.

I have complained to the ICO - although MHB still call.

 

They dont seem to want to write, which I understand why as they are a pile of f*****s who dont want any evidence. however is there any way that I should just speak to them on the phone? Get rid of them that way? Tell them im recording the call etc?

 

I really cannot deal with the five or six phone calls a day
