  1. Hi all, I am certain this has been discussed but having a tough time dealing with MMF/Peachy. Actually its Peachy who are causing the fuss and the headache. I got a loan from Peachy in 2012 which has since been transferred to MMF. I have seen the notice of assignment etc. I agreed a plan with MMF which I paid two months payment on however I ceased payment because another DCA had chased me for this debt which caused confusion. I cleared things up with MMF however they have a default against me on my Credit file. They have insisted that they have done everything right and Peachy as part of the handover should have removed teh account from my file. I complained to Peachy who insisted that they wont remove the default - now I have two defaults same debt which I know is not allowed. I want to go as formal as possible against Peachy and really get my hands on them, in all honesty I have been dealing wwith MMF who have been of great help although 'Mike' needs to shut up. How can I go about this as it seems that neither party wants to remove this debt and given that MMF own the debt now, Peachy are in the wrong. How should I complain to the ICO? Is there a template a formal route? Many thanks for your help.
  2. Sorry Brigade, quick question, you say they cant change default date but if the debt was assigned to them and they are now the new owners of the debt - they cannot add themselves as new owners as the defaulted creditor with eg todays date?

  4. Hi all, I was dealing with Gothia regarding a debt I owed a while ago (three years ago) which I totally forgot about. It was my fault for forgetting. Gothia hadnt responded or had no interaction with me for the past two years. Last week MMF got in touch with me and suggested that they now own the debt, me being suspicious I requested they send me evidence to suggest that the debt has been passed onto them. They sent me 'evidence today' stating that they have been assigned the debt from Mackenzie Hall (never ever been contacted by them EVER) and the letter was dated 9th July 2013 i.e. TOMORROW. It was also on their own letter head and everything. It appeared more a declaration which was obviously factually incorrect (mackenzie hall never had the debt it was Gothia) Three things, Firstly - does this sound dodgy? seeing as I have never ever had contact from Mackenzie Hall EVER. Secondly - when I had informed them about correspondence with Gothia, MMF mentioned that they recieved nothing from Gothia - if my debt has been assigned to them surely they would have my file with all the correspondence? Thirdly - I have a default against my name for the debt, can MMF change the default date to, for example, today? Or is the default date the original date? I am hesitant to pay MMF and have been hard hitting with them informing them that I have my supsicions of fraudulent behaviour and would like additional clarity. Many thanks

  6. I read up on him after you told me - he is a nasty piece of work. Ill report to ofcom - so I guess I shouldnt call them and try to reason with them?
  7. I have complained to the ICO - although MHB still call. They dont seem to want to write, which I understand why as they are a pile of f*****s who dont want any evidence. however is there any way that I should just speak to them on the phone? Get rid of them that way? Tell them im recording the call etc? I really cannot deal with the five or six phone calls a day
  8. I think ill complain to the ICO - nothing to lose and everything to gain. I did pay off the loan - just not the charges of £800 which had risen whilst I was disputing. Like I say theyre defaulting me on the actual charges. This is why althis is just absoutely ridiculous - I still laugh thinking about this.
  9. Ok I understand now - my error in the first instance. So actually unless I deal with TFF directly there is not a lot I can do? especially as I paid off the loan. Its a bit of a nuisance that us mere mortals have no control over Credit reports (apart from actually paying off the loan I suppose)

At the time I was disputing the amount - is there anything I can do to state that I paid the loan off its the charges they are defaulting me on - or will I have to do a notice of correction?
  11. Its not a late payment marker. Its a red D marker that is recurring on a monthly basis - is this correct? So it reads as if I just defaulted this month... Firstly I did pay the amount but was disputing the total amount i.e. the ridiculous charges which shot up to £800 and now to £3k so they defaulted me. Secondly they didnt even send me a default notice or a notice of default which, doesnt hold up im sure as it would be a default, wasnt a default as I had paid the amount just not the £3k which im sure is increasing as we speak. Its annoying because it seems I have no control over my credit entries apart from notices of correction etc. If I "defaulted" in January 2012 why is it continuously appearing for the past 18 months? ie. June 2013. You say theyre in trouble and thats not allowed - how do I complain? I know im venturing on the credit reference agency forum here
  12. Im going to annoy you again I know. I had a look at my credit report today and didnt realise that a default is rolled over so to speak. By that I mean for the past year and a half since the original default (which I am going to put a note on my account for) its a recurring default so even this month it has come up as a default - are they alloweto do that? roll it over? So it appears that my default is this month rather than a year and a half ago.

After a stern email telling them that I consider this matter closed as I have attempted to resolve this situation via email three times - I recieved a more tailored response from MHB today (when I say tailore d- its not much and still has a standard reply but has a bit more) they accused me of using an aggressive tone (ER HELLO you have been threatening me for months) and that I have not attempted to resolve this (ER HELLO I have tried to resolve EVERYTHING - except they want it by phone I want it by writing) Out of interest can they accuse me of not trying to resolve this if they have called me but I have not picked up? I have sent written communication however and have all the evidence to prove this requesting that they resolve this matter only via written means.
