I will write to co-op on 3 June 2013 to recover an unpaid direct debit fee of £15. I will give the bank 14 days to refund the charge or I will commence legal proceedings in the small claims court. They wrote to me once before saying they were going to take £15 and I phoned them threatening court action and they said that they would waive it since it was the first occasion.

Let us know how you get on with that, I was once also with the co-op and did get some fees waived as they were applied shortly after I opened the account, any later fees I did not get returned.

Hi Bjames and I've moved your post into a new thread for you.

 

Many banks will waive a current a/c default fee if it's the first one, or if you've kept your account in good order for a year or more.

 

Beyond that, the bank is likely to refuse to refund. If you take court action to recover the fee, the bank is likely to defend and win.

 

If you can show you are suffering Financial Difficulties, you can ask the bank to refund default charges using the BCOB Reg'ns. You will have to provide an Income and Expenditure spreadsheet to prove your disposable income, or lack of it.

 

If you suffer penalty charges on a credit card a/c, catalogue a/c or a loan a/c, these charges are reclaimable in full.
