Hi all

 

I have just had another letter from Lowell (thought they had given up 2 years ago !)

 

this relates to an alledged debt to Barclays of £1,400

- I have had no contact with Barclays since at least 2000/2001 in relation to the alledged debt so I know it is statute barred,

 

the thing bugging me is that lowells are now stating on the letter

"period covered 1/10/2008 to 31/01/2013"

which I guess they are trying to sugest is within the 6 year period therefore not barred ?

 

Just to note I have Never made any contact with Lowells or any of their aliases they like to call themselves (Red Debt or whatever)

 

Do I just continue to ignore or do I send some sort of reply ?

Hi,

I suggest that you send the following letter to Lowell by recorded delivery. (this does NOT restart the SB Clock). My guess is this is a required annual statement nothing more, but let's get rid of them for good!

 

To The Compliance Manager

Lowell.

 

Ref: as on their letter.

 

Sir/Madam,

 

I refer to a letter received from Lowell on xx xx xxxx and have no knowledge of any such matter currently owed by me, please note I do not acknowledge any debt to Lowell or any company it may claim to represent.

 

How ever this communication has prompted me to review my credit history and I have concluded that any such alleged debt is statute barred, therfore I will not make any payment in regard to the alledged debt.

 

You WILL now cease to process all data relating to me and remove it from your records.

 

I am fully aware of the OFT Guidance on the pursuit of statute barred debt.

 

This is my final response.

How do they word the letter ?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Make sure to write statute barred as:

 

STATUTE BARRED

 

 

Sometimes lowell's has trouble understanding and reading english.

 

You could even make it multicolored just so they get the message :)
