Hi,

 

cut a long story short

 

i told tmobile where to go three months before my contract was up back in 2010,

 

they sold my details to a company called t3,

 

they constantly harrassed me to join them and after asking where they got my details from they told me they bought them off of tmobile!

 

I called tmobile to explain this and that someone was selling details, i beleave this was even in the press!

 

I said im cancelling my contract and left it at that!

 

They sent me a final adjusted bill including an early terminationn fee, i didnt pay and never heard from them until they sold my debt in 2012 to sigma,

 

now i havent responded to them

 

i have court claim issued,

 

please help as i dont know what to do,

 

shall i file my defence and hope for best?

 

Or take up a dispute with tmobile as this was left and never chased just sold.

So you didn't fulfill your contract?

 

tmobile then passed you details on to a debt collection agency (within the terms of the contact) and you still didn't pay?

 

you then get a final billing with a correct early termination charge and still don't pay?

 

what defense do you think you may have?

when you org phoned them, you phoned to say you were not conitinuing

and they renewed without your consent?

Basically i thought i had grounds to terminate the contract as they sold my details, i told them this and they sent final bill, i never paid

 

so your contract ended then i3 months later?

 

and they billed you following its closure ?

 

or i think it unfair IF they charged a termination fee if this had only 3 months to run.

The way I read the OP it was that,

3 months before the end of a contract period with T-Mobile,

the customer started receiving phone calls from a 3rd party company called T3

who were trying to entice the OP into signing up with them for a new contract.

 

When the OP enquired as to how this 3rd party company had obtained their details they were told it was through T-Mobile.

 

This upset the OP who didn't want their information passed on for sales purposes and, as a result,

they told T-Mobile they were through with them and refused to continue with the last 3 months of the contract.

 

This is what has led T-Mobile issuing a final bill including an early termination fee.

 

The OP has refused to pay all/some of this bill (that bit is unclear) which has led to the claim being issued against them in the county court.

thats how i read it feebee that the op stop paying 3 months before then end on the contracted period

Ok so cut a long story short

 

I received a court letter from HL,

 

debt is with tmobile and has now been paid in full with satisfied marked on file,

 

now I do not owe them any money is still a chance I can get the default removed,

 

I have a feeling they do not have any paperwork and will try and follow through

 

if anyone can guide me that would be appreciated,

 

i get the gist of it but where to start as i paid hl,

 

cra says sigma but original debt with tmobile

Sort of, I never got a ccj as i payed what they were requesting, just want to see if they have evrything in order and if not try and get the default removed, many thanks

 

 

 

Why should the default be removed? It seems valid to me.
