I have a quick question before I file my MCOL tomorrow, we go on holiday from 20th-28th, if we file in the 16th is there anything we're likely to need to respond to that would not wait until we return on the 28th, or would it be better to wait until we get back to file?

If you file on the 16th, it won't be deemed served until 21st, 14 days to acknowledge Nov 4th and till Nov 18th to defend

 

I thought it was 28 days from when they acknowledge service thats certainly what seems to say say on my letter from the court :confused:

No it's 28 days from the deemed date of service

 

Which is 5 days after it been issued is that correct ???

 

So if my mcol was served on 12/10 they have until 31/10 to acknowledge it. And one way or another it should be sorted by 14 /11 if you include the 5 days for it to be considered issued by the courts??

 

Thought I had all the time scales worked out :|

 

Hope you can clear this up for me. You have helped me quite abit recently Michael Browne cheers ;)

If it was issued on the 12th, then yes they have till the 31st.

If it was served on the 12th then they have till the 26th

And then 14 days from the 31st (14 novmeber to pay up) then even if they acknowledge before the deadline making it a maxium of 33days (including 5 day peroid) for them to sort it out.

 

To hopefully finally conclude if they do acknowledge they have until the 14 at the latest to pay up :D

Issued on the 12th

Deemed served on the 17th

Acknowledge by the 31st

File defence by the 14th (this does not mean they have to pay up)

 

Yeah bad choice of words on my behalf I suppose. But they should be a development one way or another.

 

But if they haven't made a offer by then or entered any defence I can file for judgement correct?
