  1. It will normally take them this long at least to acknowledge it, so that'll be fine!
  2. I claimed for a joint account, and although my husband and i are still together, i claimed only in my name, and all the letters were signed only by me. It was never an issue, no one ever brought up the fact it was a joint account and i won in full! Hope this helps!
  3. As you know the amount theres now no need to hang about! Send the prelim letter, wait 14 days, send the LBA letter, wait 14 days, file MCOL. Unless you recieve a full settlement at any time during this period, stick to your time table. If they offer you partial amounts, i think it's always best to be polite and respond with a rejection letter, should it get to court you want the judge to look favourably on you!
  4. I'm pretty sure that you can have your husbands name taken off the account, which would then have any insolvency 'locks' taken off as your not bankrupt. Even people who are bankrupt though are entitled to be able to feed their children and pay living expenses. If i was you, i'd take a copy of the letter saying that the OR has no interest in the money in the account, and demand to speak to the branch manager, you need a proper explanation as to why HSBC have done this, get a letter from them if you can with their explanations. If you have incurred fines from non payment of things, you can certainly hold HSBC responsible, and liable for them, if their explanations are not in line with bankruptcy procedures. Don't wait for an appointment, go into your branch and tell them it is a matter of urgency. Good Luck!

I think what you can do, although read through all the threads on this, is argue that if they hadn't charged you you wouldn't have had to take the loan out, so you could get the interest back on the loan, but not the loan itself as they'll refund the charges, and if they refunded the loan they'd in effect be giving you the money back twice. You'll need to work out how much of the loan was made up of charges, and then calculate the interest accordingly. Hope that makes sense, and good luck!
  7. The solicitors would simply say they haven't recieved the forms, the judge would then set the judgement aside and HSBC would pay up fast to stop the judgement being applied again.

It's not quick if thats what you mean, but considering they've had your money for anything up to six years and you never thought you'd get it back again, i certainly didn't mind waiting a few weeks. Mine was five weeks start to finish. Good luck with your claim, HSBC take longer with some than others, but everyone gets their money back in the end, and the for days when it feels never ending, post on here and someone will be there to reassure you. They're an ecxeptionally friendly bunch!!!!
  10. The whole process was dead easy, it's just a question of time, and making sure you follow everything on this site. Theres no quick way around it, and the whole thing took five weeks start to finish for me, including having to file with MCOL.

I honestly think that when the claims get to this stage, it's because you've somwhow slipped through HSBCs 'net' as it were, i don't think they let it get this far deliberatly, it's not in their interest to. I would give DG solicitors a ring and talk to them, tell them that you have now requested a judgement, i think you'll find they'll move pretty quickly.
  12. The money was in my account within 48 hours after i faxed back the settlement letter. If you need a cheque though i think it takes longer, theres lots of threads about this though.
  13. Thanks alot! I'm going to ask them to halt any action until the charges have been sorted, i think they cannot take any recovery action if theres a dispute on the account? Anyone know if this is correct? I need to wait for my settlement from HSBC to come through so i can get another car!

  15. Hi, wonder if anyone can help....we have paid nearly half of the HP agreement to a finance company, now we want to give the car back to them as it's just to expensive. My husband asked how we go about doing this and was told to wait for them to get in touch. The next letter we recieved is from a reposession company who want to collect the car. Obviously we don't want the car to go to auction because we'll end up owing them money (we are in arrears incidently, but even with the arrears we have still nearly paid half). We told them we wanted to give the car back to which they obviously ignoed us, so what i want to know is can i still exercise my right to return it. There are also nearly £1k of charges to the account, but i guess thats a different issue. Any help would be greatly appriciated!!!!!!!!!!!!!!!!!!!!!!
  16. Another thing, i think you should be claiming the interest, it adds up to quite a bit. Don't let the banks have it!!!!!
  17. Right, the 8% is worked out for you in the spreadsheets you should have used. Don't try and work it out yourself, it's much easier (and more accurate) to use the spreadsheets as the 8% is added to each individual charge depending on the date it was charged. As for the court forms, in the particulars you should be stating what you're claiming, eg/ charges and the interest. So you put the charges and then copy and paste the part where the form asks you if you want the interest and add the amount in there. For the part where it asks you for your costs, eg/ full amount claimed, add it all up, so charges, interest and court costs and put the figure in the total amount claimed box!

My ever sensible husband's made me pay my credit card, which in my opinion was plodding along nicely, but i have paid that off and have about £500 left.....he say's 'think of the interest you're saving'.....i say'think of the shopping trip i could have had!'. Anyway, i'm really pleased for you, DG had the money in my account within 48 hours, so hopefully you won't have to wait to long!
  19. That was my situation before, but i've just had a 5k claim settled so now i'm going for this! I don't really see how they can wriggle out of it:)

  21. I'd just ring the customer service line for MCOL and ask whats going on. It's possible your claim just hasn't been updated, but at least get something from them that says the claim has been settled, it will just avoid any come back on you.
  22. Also, you claim back the full amount, £12 is NOT reasonable, and they owe you for every simgle time they charged you. Simply because they're not allowed to.
  23. You can claim these £125 charges back, HSBC don't break them down for you, so you just write 'total charges' in the spreadsheets. No, they are not the total amount of charges you had that month, they are in addition to any other charges you incurred. I has charges on my statements, in one specific month, that included 4 x £30 charges for returned direct debits, 3 x £10 charges for 'card misuse' and total charges for £125. (it was i admit, a bad month:razz: ) but i rightfully claimed for all this back, and got it. Simply add up anything that the bank has charged for and get it back:)
